State reminds fuel companies on law about advertising cash or credit prices; Will start enforcing if the practices do not change to comply with the law

Consumer inquiries have led the State to look at listed prices for fuel companies. The State has called on MEMA to get the word out on compliance with Maine law.
In many instances, the prices listed on their websites or on various multiple-listing price sites turn out to be the discounted cash prices, rather than prices available to those consumers who use a credit card.
Maine law permits reductions from advertised prices for use of cash or checks, but does not permit increases from advertised prices for use of credit. That is termed a surcharge.
To summarize, a dealer can list both prices, or can list the undiscounted price that’s available to credit card users, but what they cannot do under Maine law is list just the discounted cash price and have consumers "surprised" with a higher price for credit cards when it comes time to pay.
The State has said that they will begin enforcing shortly. Please make the changes to advertising if not in compliance.
