The Department of Labor on Wednesday released the final version of a rule requiring employers to disclose relationships with the consultants they hire to help persuade workers not to form a union or support a union’s collective bargaining position.
The department said the rule, which will apply to agreements made after July 1, is necessary because workers are frequently in the dark about who is trying to sway them when they exercise their labor rights. Under the prior interpretation, reporting was effectively triggered only when a consultant communicated directly with employees. The final rule maintains the Labor-Management Reporting and Disclosure Act’s (LMRDA) section 203(c) advice exemption and the traditional privileges and disclosure requirements associated with the attorney-client relationship. The new rule will require employers to disclose in government filings any consultant they hire to develop plans or policies for supervisors involved in attempting to persuade workers, who create materials that will be distributed through the workplace for this reason, and who lead seminars on how to discourage workers from forming unions or bargaining collectively. In addition to disclosing the hiring of a consultant, the employers will have to disclose the fees involved. The consultants will also have to disclose the relationships and fees in filings of their own.

Drivers 55 and older face double the risk of dying in a work-related motor vehicle crash than younger workers, according to a new fact sheet from NIOSH on how employers and workers can prevent crashes involving older drivers. Among employees 55 and older, crashes make up 32 percent of work-related fatalities. The fact sheet details age-related physical and cognitive changes — such as decreased eyesight, hearing loss and diminished cognitive abilities — that can affect an older worker’s driving. Accommodating these changes can help keep older drivers safe, NIOSH states.
