Misclassification: Independent contractor vs. employee

To a client, as well as contractors, it may seem alluring to treat a worker as an independent contractor as opposed to an employee. The benefits of an independent contractor include lower tax burden, avoiding the rigidity of strict employment laws, and the ability to engage in temporary contracts with no further obligation. However, treating a worker as an independent contractor, when the nature of the work being performed contains elements of an “employee -employer” relationship opens up a client as well as workers to misclassification risk.

Report lists largest US staffing firms
Staffing Industry Analysts
Staffing Industry Analysts has released its annual list of largest U.S. staffing firms, which included 122 staffing firms with U.S. staffing revenue of more than $100 million. The 122 firms on the list generated $69.4 billion in U.S. staffing revenue, which comprised 55.9 percent of the total market.

NLRB to reconsider its position on including temporary employees in bargaining units

It appears the NLRB may again be poised to “flip flop” on whether temporary employees may be included in a petitioned for bargaining unit of the employer’s regular workforce. The issue is pending before the NLRB in the case of Miller & Anderson, Inc.

Upswing in hiring in the back half of 2015

At the halfway point in 2015, both employers and job seekers are feeling confident in their prospects, according to CareerBuilder’s Midyear U.S. Job Forecast.
