Federal Tax Update — February

In Sabolic v. Commissioner, TC Memo 2015-32, the tax court determined that a Las Vegas bartender kept accurate contemporaneous records of tips and disagreed with the Internal Revenue Service's position that he had understated tip income by about $20,000 in each of three years, amounts about equal to what he had reported. The IRS argued that the logs of the taxpayer were inadequate because he rounded to the nearest dollar.

Treasury: IRS Budget Cuts Could Endanger US Tax System

The Obama administration warned Congress that years of budget cuts to the country's tax collection agency could create a big fiscal headache. Congress has slashed the budget for the Internal Revenue Service by 10 percent over the last five years, hurting the agency's operations, said Secretary of the Treasury Jack Lew.

US Companies Are Stashing $2.1 Trillion Overseas to Avoid Taxes

Eight of the biggest U.S. technology companies added a combined $69 billion to their stockpiled offshore profits over the past year, even as some corporations in other industries felt pressure to bring cash back home. Microsoft Corp., Apple Inc., Google Inc. and five other tech firms now account for more than a fifth of the $2.10 trillion in profits that U.S. companies are holding overseas, according to a Bloomberg News review of the securities filings of 304 corporations.

Changing Legal Status Provides Extra Tax Challenges for Same-sex Couples

Both the U.S. Department of the Treasury and the Internal Revenue Service have recognized all legal same-sex marriages for tax purposes since 2013, but at the state level, the situation continues to evolve. More than a dozen states made same-sex marriage legal in 2014 alone. Same-sex couples married in those states last year, or those who changed their status from a domestic partnership, now have new filing challenges.
