Appeals court invalidates CMS contract with RACs

It may be back to square one in the Centers for Medicare & Medicaid Services' bid to create new pacts with recovery audit contractors. The U.S. Court of Federal Appeals has invalidated the current proposed contract with RACs, primarily due to their violation of U.S. acquisition regulations. The violation is based on a provision in the contract that would not allow RACs to collect contingency fees for their work until a clawback that has been appealed by a hospital reaches the second of a five-stage appeals process.

OIG presses CMS to cut hospital payments for surgeries on low-risk outpatients

HHS' Office of Inspector General is using a congressionally mandated report to repeat its call for Medicare to pay hospitals the same as it pays ambulatory surgery centers for procedures on low-risk patients. But the CMS and hospital trade groups think the OIG is on the wrong track. Even the national association representing ASCs is wary.

Emerging 'doc fix' deal includes only a partial cost offset

A proposed congressional "doc fix" deal will include a permanent repeal of Medicare's sustainable growth-rate formula and a two-year extension of the Children's Health Insurance Program with a total cost exceeding $200 billion. Only a portion of the cost will be offset by spending cuts, said four lobbyists familiar with the negotiations. Funding a permanent fix has stymied Congress during past attempts to move beyond a temporary patch for the issue, as was done last year.

Hospital staff injuries will go public with OSHA rule

Operating room nurse Bernadette Haskins, who weighs 125 pounds, says lifting immobile patients who are sometimes nearly three times her size makes the risk of injury a constant worry for her and her colleagues. "I love what I do, but the average weight of patients we take care of is about 300 pounds, and sometimes there's no extra help available," said Haskins, who works at Swedish Medical Center in Seattle.

16.4 million have gotten insurance under Affordable Care Act in past 5 years
Over the past five years, about 16.4 million previously uninsured people have gained insurance under the Affordable Care Act, the Obama Administration announced. The Department of Health and Human Services released new figures on the insured population one week ahead of the fifth anniversary of the Act's passage. HHS Secretary Sylvia Burwell said Monday it's the "largest reduction in the uninsured in four decades."

AHA report details challenges threatening hospitals' critical 24/7 role
AHA News Now
The AHA released a new report detailing the 24/7 role of America's hospitals and the challenges threatening this essential part of the nation's health care infrastructure. Rising demand for emergency care and disaster readiness; a shortage of resources and funding; a move to equalize payment across care settings without regard to the cost of maintaining 24/7 capacity; and the continued migration of care out of the full-service hospital setting pose credible threats to the hospital's ability to maintain its role as a community asset, the report concludes.
