Judge rules against White House on ACA subsidies
A federal judge in Oklahoma has ruled that Obamacare subsidies cannot go to residents of states that are not running their own insurance exchanges, a second blow to the Obama administration on an issue that threatens a key element of the health law's coverage expansion. Judge Ronald A. White said that the administration's decision to allow subsidies to go through either a state-run health insurance exchange or the federal exchange is an improper and invalid reading of the Affordable Care Act and must be struck.

ACMA goes to Washington
Today ACMA members began meeting with key legislators in Washington as part of the annual Advocacy on Capitol Hill event. Members will discuss critical issues such as observation services, RACs and the creation of an integrated chronic care delivery program.

CMS responds to hospitals' concerns about new QIO contractors

Responding to concerns raised last month by AHA and Federation of American Hospitals about the transition to two new contractors for Quality Improvement Organization Beneficiary and Family Centered Care, the Centers for Medicare & Medicaid Services said it is "actively working with the BFCC-QIOs to resolve" several challenges as quickly as possible. In a letter to the AHA, Patrick Conway, M.D., CMS chief medical officer and deputy administrator for innovation and quality, outlined a number of steps BFCC QIOs have taken to address challenges that patients and hospitals have faced with the BFCC QIOs processing appeals of hospital discharges.

CMS launches Open Payments website
Centers for Medicare & Medicaid Services
The Centers for Medicare & Medicaid Services recently launched Open Payments, a new website that discloses financial payments made by drug and device manufacturers to physicians and teaching hospitals. "CMS is committed to transparency and this is an opportunity for the public to learn about the relationships among health care providers, and pharmaceutical and device companies," said CMS Administrator Marilyn Tavenner. "This initial public posting of data is only the first phase of the Open Payments program. In coming weeks, we will be adding additional data and tools that will give consumers, researchers, and others a detailed look into this industry and its financial arrangements." Pioneer ACO program loses 3 more participants
Despite early successes for the Medicare Pioneer Accountable Care Organization program, four more hospital systems recently dropped out, leaving just 19 of the original 32 organizations, according to an article (registration required) in the Wall Street Journal.
