Summer time is a wonderful time to relax, and for some us who have suffered through a terrible winter, it's time for us to warm our bones and prepare ourselves for the next brutal cold season that will be here before we know it. Regardless of the season, there is always some natural calamity that can come our way. In particular, during the summer months, it seems that tornadoes and hurricanes have been coming on with much more frequency and intensity over the past few years.

If and when calamity does strike, the last thing we need is to find that our offices have been completely destroyed and all the work that we have done for the past twenty years is now gone. Spend the time to make sure that your company is properly insured under all categories of property and casualty insurance, which includes business interruption insurance -- another part of strengthening your total risk management system. This insurance product will pay for many kinds of weekly and monthly expenses, as well as lost income while you try to recover from all that has been whisked away by nature's forces.

ABA: Lawyers given 'okay' to review jurors' social media sites

The American Bar Association (ABA) has ruled that lawyers are allowed to search a juror’s or potential juror’s public Internet presence, which can include postings by the juror in advance of and during a trial. However, sending “friend” requests, “following” or other such access requests are considered an ethics violation, the ABA said.

Michigan Court rules forwarding companies fall under definition of collection agency

On June 13, the Michigan Supreme Court vacated the Michigan Court of Appeals opinion in part, and held that because forwarders are “directly or indirectly engaged in soliciting a claim for collection,” they satisfy Michigan’s statutory definition of “collection agency.” The Michigan Supreme Court ruled that although forwarding companies do not contact debtors themselves, they are soliciting a claim for collection under the statute when they “contact creditors asking for debts to allocate to local collection agents.”

Wall Street sees big money in student-loan defaults

Leave it to Wall Street to figure out how to make a quick buck from the burgeoning student-loan crisis. The FOX Business Network has learned that investment firms such as private-equity powerhouse Carlyle Group are weighing whether they should snap up student-loan collection agencies — companies that help lenders recover funds from borrowers who default on their loans.

Suit over law firm's debt collection practices is revived

A suit over debt collection practices brought against a Philadelphia law firm has been revived by the U.S. Court of Appeals for the Third Circuit. The appeals court ruled that people who receive notices and dispute the debt they're charged with carrying don't have to first validate the amount before filing a claim under the Fair Debt Collection Practices Act. That decision is a reversal of the district court's opinion and goes against the holding of three other district courts in various circuits.

Debt collectors turn to social media to track down delinquents

After more than a decade of eluding phone calls, a Brighton Heights man said his experience with a third-party collection agency hired to recoup his student loan debt went from marginally annoying to borderline cyber stalking. Even for loan scofflaws there are rules collection agencies must follow, and two government agencies are working to make that better known.
