Looking for the right person to fulfill a position is not an easy endeavor. Searching, interviewing and negotiating the employment terms and conditions all take a lot of time, energy and expense.

Unfortunately, there are some not-so-good people out there looking for jobs, and even though it’s getting harder and harder for people to hide their dirty laundry, the unsuspecting employer could be easily fooled. So, no matter how wonderfully the candidate may perform during the interview and you’re inclined to make them an offer on the spot, take your time and spend a little money on getting a background check. Background checks, like many kinds of investigations, run the gamut and can cost from less than a hundred dollars to several hundred dollars. How far back and how deep you would like to go into someone's background all depends upon what they will be employed to do for you.

In the end, regardless of the costs, knowing if someone has something in their background that could negatively impact your business will be well worth the money spent.

Collection attorneys must conduct 'meaningful review' of suits under FDCPA

A U.S. District Judge recently ruled that a debt collection law firm violated the Fair Debt Collection Practices Act (FDCPA) by not conducting a “meaningful review” of a collection action filed against a consumer. The judge used reasoning from the landmark case Lesher, decided three years ago. Judge Kevin McNulty, in the District of New Jersey, granted the plaintiff summary judgment in Bock v. Pressler & Pressler.

CFPB clarifies how regulations apply to same-sex married couples
The Association of Credit and Collection Professionals
Consumer Financial Protection Bureau (CFPB) Director Richard Cordray recently issued a memo to staff clarifying that, to the extent permitted by law, it is the CFPB’s policy to recognize all lawful marriages valid at the time of the marriage in the jurisdiction where the marriage was celebrated. The policy was issued in response to a U.S. Supreme Court decision in U.S. v. Windsor on June 26, 2013, which struck down Section 3 of the Defense of Marriage Act as unconstitutional.
