 Assistance

A question I get from time to time: "When should a forwarder request assistance with a law list's service department?" Just to clarify, when a forwarder decides to "request assistance," it usually means that a collections claim is not being processed quickly enough — at least in the eyes of the forwarder.

First let me remind everyone that the ALQ service department is here to help at any time. If you, as a forwarder, have an immediate need you should not hesitate to contact us.

On the other hand, we ask forwarders to have a bit of patience. Whenever someone asks us to open a file and "requests assistance," that forwarder is basically filing a formal complaint which automatically becomes a black mark on that law firm's record. It may be justified. But we suggest you give the law firm a fair chance to not only respond, but also resolve the problem or situation. Again, we are eager to help. Most often, it's just a matter of helping restore the lines of communication.

And if it happens to be something more, that's when you'll find out the real value of forwarding your claims through ALQ.

Private firm sues CFPB, challenges board's constitutionality

A lawsuit challenging the constitutionality of the newly established Consumer Financial Protection Bureau has been filed in federal court. The lawsuit was filed by Morgan Drexen, a Costa Mesa, Calif., company under CFPB pressure to turn over millions of private consumer information files as part of the agency's controversial consumer surveillance program.

Prohibition of unfair, deceptive or abusive acts or practices in the collection of consumer debts
Consumer Financial Protection Bureau
Under the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act), all covered persons or service providers are legally required to refrain from committing unfair, deceptive, or abusive acts or practices (collectively, UDAAPs) in violation of the Act. The Consumer Financial Protection Bureau (CFPB or Bureau) is issuing this bulletin to clarify the contours of that obligation in the context of collecting consumer debts.
