More than 200 Business Groups Oppose Border Adjustment Tax
American Supply Association
As tax reform slowly gains steam, multinational corporations with an open line to the White House and President Trump are lining up in support of taxing imports, to the detriment of many in the small business community, including members of ASA. As our letter states, “the Border Adjustment Tax is not simple or fair. It proposes a massive tax increase on consumers and would result in increased costs on everyday necessities like food, clothing, gasoline and prescription drugs – necessities that Americans rely on daily – by as much as $1,700. It is really a ‘cost of living tax’ that will make the lives of millions of middle-class Americans harder and more expensive.” Read the full letter here.More

States Set Out to 'Kill Quill' and That's Not Such a Bad Thing
Bloomberg
At least 15 states have their sights set on ending “Quill”, which refers to the 25 year-old ruling by the Supreme Court in Quill Corp. v. North Dakota that’s led to the current state brick-and-mortar sellers find themselves today: at a disadvantage to those that sell exclusively over the internet and are not collecting sales tax. Many states, led by Alabama, have dared out-of-state retailers to sue them, such as their attempt to require that businesses that do more than $500,000 of sales in the state would be deemed to have substantial nexus. It is moves such as this, coupled with Justice Kennedy’s 2015 call for Quill to be revisited and hopeful ally Judge Gorsuch awaiting confirmation that the courts could overturn this precedent, but we still need Congress to act and set a national standard once and for all, read the multiple scenarios in play.
