Bipartisan, Bicameral Effort to End Online Sales Tax Disparity

Last week, South Dakota Representative, Kristi Noem, took the lead in introducing the Remote Transactions Parity Act (RTPA). Joined by six Republicans and five Democrats in the House, the legislation would end the unfair disparity that exists when remote or online sellers are not required to collect and remit sales taxes on sales made over the Internet. In the Senate, supporters went above and beyond the call of duty and introduced their version, the Marketplace Fairness Act with 14 original co-sponsor, adding three more this week, building the momentum we need to get this passed once and for all. As our letter states, “the growth of e-commerce should benefit all sellers. The status quo, however, affords special treatment to “remote sellers”, distorting the marketplace and impeding the ability of local brick-and-mortar businesses to compete.” See our letters of support here and here.More

Opposition Bill Drafted to Quash Marketplace Fairness

Wisconsin Representative Jim Sensenbrenner, a longtime opponent of the Marketplace Fairness Act is expected to introduce the No Regulation Without Representation Act. Unlike RTPA and MFA, both of which empower the states to require remote sellers to collect and remit sales tax just as members of ASA must do (overturning the 1992 US Supreme Court Quill decision). If passed, the Sensenbrenner bill would codify or make law the 1992 decision that set this issue in motion in Quill vs. North Dakota. In Quill the high court declared that a business had to be physically present in a state before that state could require the business to collect use tax on its behalf. ASA has been educating members of Congress of our opposition to this legislation and why Congress should act to end this ongoing sales tax disparity by passing RTPA/MFA. More
