DOL Seeks Industry Input on Overtime Rule

The Department of Labor is seeking information from stakeholders on how it should proceed with a new rulemaking to replace the Obama Administration's regulation on eligibility for overtime pay. Currently, the overtime rule is blocked from taking effect by a preliminary injunction issued last November. The Trump Administration has filed its final brief in the appeal of that ruling, and has argued that the Secretary of Labor has the legislative authority to issue a salary threshold, but that the salary threshold set by the Obama Administration was inappropriate. The DOL is seeking stakeholder input from the employer community to move forward with this regulation, in a way that is less burdensome or costly to small businesses. In particular, the Department seeks comment on and information relating to the questions in the survey we’ve prepared. Responses are due to the Department of Labor by September 25, so we're seeking employer input by September 15. Total non-residential construction during the 12 months through June is up 2.5% since last year. Plan for stronger rates of growth in construction of warehouse buildings, manufacturing buildings, and office buildings through 2018. U.S. total residential construction during the 12 months through June rose 10.4% above last year. The rate of growth will slow through 2018 and 2019. At least eight people are dead and more than 2,000 have been brought to safety since Hurricane Harvey made landfall Friday in Southeast Texas. The Category 4 hurricane dumped as much as 2 feet of rain on parts of Texas, Alabama and Louisiana in just two days, causing catastrophic and widespread flooding that is only expected to worsen as rain continues to pelt the region Monday afternoon. Meanwhile, plumbing businesses in and around Houston — which has been hit especially hard by the historic flooding — are just beginning to survey the damage to their own property, and many are still attempting to reach employees as cell phone coverage remains unreliable.More
