Businesses Hoping Temporary Injunction Becomes Permanent

Just before Thanksgiving, as businesses were gearing up to implement the burdensome, new overtime rules by the Department of Labor (DOL), Judge Amos Mazzant of the Eastern District Court of Texas issued a preliminary injunction effectively postponing the start date, which was set to take effect on December 1. One of the most important items of this ruling should be that it is preliminary, aka: TEMPORARY. Law firms across the country have received questions regarding this ruling and how businesses should plan to move forward. Most importantly, many of have inquired whether the injunction will last into the next administration.

Post-Election Economic Outlook Unchanged

Donald Trump's election as the next President certainly caught many of us by surprise. However, it really does not alter the macroeconomic outlook for 2017. The leading indicators were going up before the election, and analysts at ITR Economics expect that they will continue to rise post-election. While the rise is still likely, it's not likely to be any better or any worse. The new Administration and Congress are more likely to have a bearing on 2018 and beyond. Overtime Overhaul: How Employers Can Deal with Court Decision on New Rules

The Nov. 22 ruling by a federal judge in Texas to suspend new rules governing overtime pay has left employers across the country scrambling. Many companies had spent months preparing for the new regulations, which were set to go into effect Dec. 1, before the decision from U.S. Court Judge Amos L. Mazzant III of the Eastern District of Texas to issue a preliminary injunction stopping the rules from going into effect.

ANSI Standards Action (November 2016)

The latest issue of ANSI Standards Action (Volume 47, No. 47 and No. 48 ) is now available. Also, a synopsis has been generated which indicates the pertinent information. Some of the highlighted items for the month of November includes: ASSE has announced the formation of a new standard to address tankless water heaters (BSR/ASSE 1085-201x). ASSE currently has a call for members to generate the ASSE 1085-201x. Tankless water heaters with integral scald and thermal shock protection for plumbed emergency equipment. The International Code Council (ICC) is accepting public comments for a new standard for rainwater collection systems. The deadline to submit public comments is January 2, 2017.

EPA To Review Asbestos As It Releases First List of Chemicals To Review Under New Chemical Safety Law

The EPA has announced the first 10 chemicals it will evaluate for potential risks to human health and the environment under the Toxic Substances Control Act (TSCA) as amended by the Frank R. Lautenberg Chemical Safety for the 21st Century Act. Under TSCA EPA is now required to evaluate existing chemicals to determine whether they "present an unreasonable risk of injury to health or the environment." The Agency will start the risk evaluation process for these first 10 chemicals and within six months release a scoping document for each chemical which includes the hazard(s), exposure(s), conditions of use, and the potentially exposed or susceptible subpopulation(s) the Agency plans to consider for the evaluation.
