Infrastructure projects funded under public private partnership and private finance initiative models are less likely to default on their loans, according to credit rating agency Moody's. The agency's updated study, which builds on research originally published in 2010, also found that banks were more likely to recover the full amount of the outstanding debt in those PPP and PFI cases that did end in default. Across North Carolina, the state Department of Transportation is conducting a major overhaul of aging bridges. A basic tenet of contract law has always been that only parties to a contract may sue and be sued for breach of duties arising out of the contract. For example, a subcontractor typically cannot sue an owner for the latter's breach of the prime contract. Conversely, the owner cannot sue the subcontractor for a breach of the subcontract with the prime contractor. If the subcontractor performed poorly on the project, the owner may look only to the prime contract to determine whether the subcontractor's performance constitutes a breach, and if so, it may proceed only against the prime contractor. The high-speed rail project that Gov. Rick Scott doomed last February by turning down more than $2 billion in federal money would have made an annual surplus of $31 million to $45 million within a decade of operation, according to a state report. The Florida Department of Transportation sent the report to the Federal Railroad Administration in November. The Tampa Tribune obtained the document after a lengthy public records request. More

Sundt Construction Inc. has been awarded a $71 million design-build contract for a a 1,200-bed student housing project at the University of California Davis, the company announced recently. The 330,000-square-foot Tercero Student Housing Phase III project is seven buildings consisting of 108 single units and 537 double units, several lounges, study areas, computer centers and gathering spaces.
