    7 Questions for EBA President Jason Leif

    It's hard to identify a core energy issue for a group with 2,600 members working in every corner of the energy industry, but Energy Bar Association president and Jones Day partner Jason Leif says regulations controlling carbon emissions are so transformative that they affect the work of virtually any energy attorney. That means carbon regulation will be a prominent topic at the continuing legal education seminars the EBA hosts throughout the year, and also at its two national conferences.

    Walther Foundation Awards CFEBA A Grant
    EBA
    Many thanks to the Walther Foundation for awarding the CFEBA a $5,000 grant, which will be used to help fund worthwhile energy-related charitable causes. We want to also express sincere appreciation to Patrick Kealy, a Trustee of the Walther Foundation Board and a former CFEBA Board Member for all his efforts in helping CFEBA obtain the grant.

    Two Summer Interns Funded By CFEBA Are On Board
    EBA
    Two of the four summer interns that are being funded by CFEBA for 2014 are now on board. Robert Goldfin, a law student at George Washington Law School, is interning at the FERC and Laurie H. Thomas, a law student attending William Mitchell College of Law in St. Paul, Minnesota, is working with the Minnesota Public Utilities Commission.

    Seeking Nominations for the Paul E. Nordstrom Service Award
    EBA
    EBA's Committee on Nominations is collecting suggestions on candidates for the Paul E. Nordstrom Service Award. This Award was created in memory of Paul Nordstrom, a past President of the Energy Bar Association ("EBA") and motivating force in organizing the Charitable Foundation of the EBA ("CFEBA"). The first award was given to Paul posthumously; subsequent honorees have been Sheila S. Hollis, Richard Meyer, Freddi L. Greenberg and William A. Mogel. The award honors and recognizes exemplary long-term service or a particularly significant example of public service by a current or past member through the EBA, the CFEBA, or the Foundation of the Energy Law Journal. Exemplary community service outside of these organizations also may be considered. Recommendations are due by August 4, 2014.

    Ethical Considerations in Responding to FERC Investigations

    On Tuesday, July 22nd, the EBA Houston Chapter will host a luncheon program entitled: Ethical Considerations in Responding to FERC Investigations at the Houston office of Jones Day at 11:30 am- 1:00pm (CT). This presentation is designed to provide company counsel, compliance officers, outside counsel, and company employees with commercial responsibilities with some insight and practical tips regarding ethical responsibilities when FERC comes calling, especially during the critical, first 72 hours following receipt of a notice of an informal inquiry or formal investigation. The panel will focus on ethical considerations for lawyers involved in such inquiries and investigations, based on FERC's Policy Statements on its Penalty Guidelines and the ABA's Model Rules of Professional Conduct.

    US oil export decision opens new potential gateway for industry
    National Geographic
    The U.S. Commerce Department quietly has cleared two Texas-based companies to export a type of crude oil, slightly easing decades-old restrictions and possibly opening the door for many other oil producers. The move comes amid debate over whether the export prohibitions should be re-evaluated as domestic production booms.

    Reid: FERC nominees to get vote when Senate returns from July 4 recess

    The Senate will vote on Federal Energy Regulatory Commission nominees Cheryl LaFleur and Norman Bay when the Senate returns from its Fourth of July recess, Senate Majority Leader Harry Reid, D-Nev., told Bloomberg BNA. “We are going to try get them done, probably not this time, but [the] next week we come back,” Reid said in a brief interview.

    Senate Dems push bill to stop gas price spikes amid Iraq turmoil
    The Hill
    Sen. Bernie Sanders, I-Vt., is pushing legislation that would give federal regulators emergency power to reign in speculators from "taking advantage of turmoil in Iraq" to spike gas prices. The bill would compel the Commodity Futures Trading Commission, which is tasked with regulating oil markets, to use its authority and energy powers to eliminate excessive oil speculation. Sanders introduced the bill June 27 with 13 other Senate Democrats.

    When judges set policy

    Environmental policy set by judges can thrill lawyers but confound everyone else. This, of course, explains the energetic litigiousness of environmental groups unable to work their will politically. U.S. policy related to climate change comes increasingly from the judicial system. Congress wisely refuses to impose economic hardship as a precaution against postulated overheating of the planet. Taxing carbon, by one means or another, and replacing cheap energy with expensive alternatives would raise energy costs painfully. This is certain. Payoff, in the form of meaningfully avoided warming, is conjectural. Political outcomes pointedly and consistently reflect strong American distaste for sacrificial tradeoff such as this.
