    Seeking Nominations for State Regulatory Practitioner Award

    The State Commission Practice and Regulation Committee is soliciting nominations from the EBA membership for the 2014 State Regulatory Practitioner Award. This prestigious award, which recognizes innovation and superior advocacy by members of the state utility regulatory bar, will be presented at the EBA’s Mid-year Meeting and Conference in Washington, DC in November. Prior recipients of the award include Ben Stone, James Van Nostrand, Sonny Popowsky, and Jeff Genzer. Please submit nominations to jtg@dwgp.com by 5:00 pm Eastern on Friday, September 12th.

    Primer Series: An Introduction to Hydropower Law and Regulation

    The National Hydropower Association and the Energy Bar Association are pleased to team together to present a primer on the hydroelectric industry. The Primer will be held in Boston, MA on September 15-16th The purpose of the primer, An Introduction to Hydropower Law and Regulation is to provide attorneys who are new to the practice of hydroelectric law a foundational understanding of the hydroelectric industry and how it is regulated by teaching basic industry fundamentals and core regulatory and legal concepts. The primer also provides an overview of key legal and policy issues affecting the industry today and will include a tour of the Boott Hydroelectric Project.     Celebrating 60 Years!

    Chief Judge Wagner will achieve 60 years of federal civilian service this month. There will be a special recognition reception and awards ceremony on August 28th at 2:00 p.m. in the Federal Energy Regulatory Commission meeting room. The EBA membership is welcome to attend and enjoy refreshments after the ceremony.

    Take The Quest on August 21st!

    In honor of the 2Q, 2014 Book of the Quarter, The Quest, the Book Club is teaming up with the Young Lawyers Committee to take on a quest of its own!

    Please join the Book Club and the YLC the evening of Thursday, August 21st to participate in a Washington, DC Urban Adventure Quest. We will meet at 5:30 pm at Elephant and Castle, located at 1201 Pennsylvania Ave., NW (important – there are two E&C’s in DC, so please confirm the address), and will embark on the scavenger-hunt style adventure in one or more small groups no later than 6:00 pm (a happy hour will continue at E&C during the excursion for those unable to participate). We will reconvene at E&C at 8:30 pm to tally scores and discuss our quest and The Quest. ALL ARE WELCOME: you do not need to be a YLC member or a Book Club member (or have read any of the books) to participate!

    Every EBA Member is invited join EBA Book Club for any or all of its quarterly sessions. Let this be your inspiration to read industry-related literature at your own pace and discuss, ask questions, share perspectives and debate the book’s themes and conclusions with other EBA Members. The EBA Book Club has both virtual and physical platforms to interact with other members. Virtually, the EBA Book Club hosts a forum under the group “Energy Bar Association Book Club” at www.Goodreads.com (free registration required). In addition, the Book Club holds an in-person meeting once a quarter to network and discuss the preceding “Book of the Quarter”. As Congress is considering updating the Communications Act, UTC and DOE is holding its 5th Annual Critical Infrastructure Communications Policy Summit, September 15, 2014 at the Willard Hotel, in Washington, DC. This year's Summit focuses on getting the Communications Act rewrite right in order to promote the development of reliable, secure and robust utility and critical infrastructure communications networks.

    NERC Compliance & Enforcement for Practitioners

    On Thursday, October 2, 2014, EBA's System Reliability & Planning Committee along with the Young Lawyers Committee are planning a half-day program designed for new and seasoned NERC electric reliability practitioners alike, this half-day session will explore NERC's transition from a voluntary organization to the FERC-certified ERO, as well as the mechanics of NERC's compliance and enforcement process and procedures. This will be followed by a panel discussion with NERC and industry experts covering reforms to NERC's compliance and enforcement program, and the role of the lawyer in NERC audits and investigations. The forum will conclude with a networking cocktail reception.

    More changes at FERC as Commissioner Norris resigns

    John Norris has submitted to President Obama his resignation from FERC effective Aug. 20, nearly three years before his current term is due to expire, the commissioner said late Thursday. Norris said he is leaving the Federal Energy Regulatory Commission to become minister-counselor for the U.S. Department of Agriculture in Rome, Italy. "It has been a great honor to serve with all the exceptional professionals and public servants who make up the FERC family and so many dedicated energy stakeholders in the public and private sectors," Norris said.

    California could rewrite the rules for distributed demand response
    The Energy Collective
    You might imagine that California, the land of energy efficiency, smart meters, rooftop solar panels and plug-in electric vehicles, would also be leading the country in demand response — the term of art for turning homes and buildings into grid-responsive energy assets. But you’d be wrong. In fact, California has lagged behind other parts of the country in creating the programs and markets to jump-start demand response. For the past four years running, it’s failed to meet a statewide goal of getting enough demand response to cover 5 percent of its system peak load — and that’s just a measure of its inability to meet old-fashioned peak reduction from large industrial and commercial customers and power generators.

    New Jersey Gov. Christie vetoes bill aiming to ban fracking waste

    For the second time in two years, New Jersey Gov. Chris Christie has vetoed a bill that would have banned the dumping of fracking waste in New Jersey. Environmentalists and lawmakers from both parties had championed the measure, which would have prohibited companies from treating, discharging, disposing and storing waste from hydraulic fracturing.

    Feds vs. feds: EPA questions energy agency's environmental review

    Federal energy regulators have failed so far to show how a proposed liquefied natural gas project would affect the air, water and wetlands along Corpus Christi Bay and how to limit those effects, the Environmental Protection Agency says. In a recent letter to the Federal Energy Regulatory Commission, the EPA said its fellow agency's draft environmental review for Cheniere Energy's proposed export and import facility was insufficient.
