The Colorado Public Utilities Commission has issued an order that gets rid of a requirement that renewable energy facilities go through an auction process before qualifying for PURPA contracts – as well as deciding to require utilities to examine energy storage as an alternative to infrastructure.
The Federal Energy Regulatory Commission proposed a rule to narrow the scope of utility mergers subject to its jurisdiction in response to recent amendments to the Federal Power Act.
In September, President Trump signed into law changes to the FPA that set a minimum of $10 million for the value of merger transactions that must be reviewed by FERC. Previously, there was no minimum threshold.

Join EBA Nuclear Regulation Subcommittee for a webinar dedicated to reviewing the 2018 legislative developments related to nuclear energy.
The program will review a series of recent FERC orders and related appellate court rulings concerning participation by demand response, energy efficiency, and battery energy storage resources in wholesale energy and capacity markets. The program will focus on how FERC described the scope of its jurisdiction in each of the orders, how the courts evaluated that scope, and the impact of those determinations on state programs regulating and/or incentivizing demand response, efficiency, and batteries.

My name is Mary Emerson. I am finishing my final year at the University of
Baltimore School of Law. I know law school is hectic and I am in this
struggle with you. But trust me, there’s more to this journey.
As your first ever EBA Student Board Member, I want to share my
personal experiences to encourage fellow students to connect, and most
important, stay involved. I know law school is busy, demanding, and so
many other “nice” words, but we cannot afford to be tuned out when we
must connect more. And that is why I couldn’t be more thankful for my
experience and involvement with the EBA!
On Nov. 27th, Petroleum Economist honored Sheila S. Hollis, EBA Past President and Paul E. Nordstrom Award Winner with the 2018 Legacy Award during a ceremony in London.

During this holiday season, we hope you get time to catch up on some reading and that it will include the latest version of the Energy Law Journal.
Below is an excerpt of the Editor-in-Chiefs Page, by long-time editor, EBA Past President and distinguished Paul E. Nordstrom Service Award recipient, Robert (Bob) Fleishman.
“Hate can have no place in our country. We need to make that clear. Not just by our deeds, but by the words we use.” – U.S. Senator Ben Cardin

Words are the lifeblood of lawyers, critical tools of our trade.
We learned in law school to choose our words carefully and wisely.
When we wield them well, clients benefit immensely.
Conversely, when we do not, we do them a disservice.
And what is the Energy Law Journal but a bunch of words on pages-
electronic and paper? We use words carefully (hopefully wisely), and understand how important it is to do so.
