Pesticide Safety Alert: Stewardship

In the industry alert distributed yesterday, NPMA indicated that:

“The Environmental Protection Agency (EPA) issued a Pesticide Safety Alert late Friday, April 10th, voicing concern that the recent incident involving methyl bromide exposure in the U.S. Virgin Islands (U.S.V.I.) is not isolated and that the misuse of methyl bromide may be more widespread. As a result, the EPA is urging state, tribal and territorial pesticide regulatory agencies in the U.S. to conduct their own investigations."

As always, when using any pesticide, NPMA recommends that members:
  1. Review the label of any fumigant used by your company.
  2. Review your service protocols to ensure they are in compliance with label directions.
  3. Review your records and record keeping practices.
  4. Review the above with everybody in your company that handles fumigants and maintains records.

Members Advised to Review Their Web Photos
NPMA
When developing their websites, pest management companies sometimes download photos/images from the internet and assume they are in the public domain and may be used without any restrictions. You may not know it, but you may be infringing a copyright. It’s not uncommon for a PMP to get a letter from an attorney demanding payment for using a copyrighted photo and threatening litigation if the company does not settle. It can cost many thousands of dollars. NPMA recommends:

1. That PMPs review their websites (and other images) to be sure they are not infringing copyrights.

2. If you need high-quality pest photos, NPMA has a FREE photo library of professional pest images available on my.npmapestworld.org for members to use on their websites and marketing materials. Please contact us at npma@pestworld.org if you need assistance logging in.

New Online ACE Exam Prep Track Unveiled

For many pest management professionals, self-study doesn't come as easy as it did back in school. Formosan Termite Alate Movement in New Orleans

A team of entomologists from the University of Florida, APHIS, and the New Orleans Mosquito and Termite Control District, led by Aaron Mullins, recently published a research paper about the swarming behavior of Formosan subterranean termites. Formosan termites, Coptotermes formosanus, are the most destructive wood-destroying pest in areas that they are found, primarily the southeastern United States, and have consistently been shown to be moved to new places by human activity. The local spread of Formosan termites by mating swarms has been less understood. In this study, alates were marked, released and allowed to swarm, then recaptured to determine their movement. The alates tracked in this study were found within 820 feet from the parent colony. From one parent colony though, alates traveled an average of over 2000 feet which is pretty far considering termite alates are considered to be poor fliers. Even more impressive, wind conditions were low during the study so flights were not substantially aided by air currents. In the absence of strong wind and light, alates were not found to move consistently in association with either factor.

This paper was published in the most recent volume of the Journal of Economic Entomology, ”Dispersal Flights of the Formosan Subterranean Termite (Isoptera: Rhinotermitidae)".

HEARD ON THE HILL

On April 6, NPMA staff met with several Congressional offices to discuss looming action by the executive branch concerning pollinator protection policy. Offices met with included key members on the House Agriculture Committee, House Agriculture Subcommittee on Biotechnology, Horticulture and Research, House Appropriations Subcommittee on Agriculture and the House Committee on Natural Resources. Due to successful NPMA member visits during the 2015 Legislative day, many of the offices met with were already well informed of our relevant issues. NPMA is continuously building relationships on Capitol Hill and is confident that we have several allies on pending pollinator policy.

If you have not done so already, please send abray@pestworld.org any notes concerning meetings with Congressional offices on Legislative Day 2015, and or any other times you interact with Congressional offices in your home district. Your contact is an invaluable tool, that NPMA staff will follow-up on to build relationships and industry allies on the Hill.

EPA Sends Clean Water Rule to OMB for Approval

Last week, the Environmental Protection Agency (EPA) submitted to the Office of Management and Budget (OMB) a draft proposed rule to update the Clean Water Act and the definition of what constitutes Waters of the United States (WOTUS). Recently, EPA Administrator Gina McCarthy stated that the new rule is significantly different from the previous draft that faced significant opposition and disapproval from Agriculture groups. If OMB authorizes the rule, EPA could release the rule in the second half of 2015. NPMA will continue to monitor the WOTUS ruling and how it could impact NPMA members.

Colorado Sunset Review of the Pesticide Applicators' Act

On April 20, the Sunset Review for the Reauthorization of the Pesticide Applicators’ Act (S.B. 119) will be introduced in the Colorado House Committee on Agriculture. S.B. 119 has already passed the Colorado Senate and is awaiting approval in the House. Without affirmative action from the House the Colorado Pesticide Applicators’ Act will essentially expire on July 1, 2015 and no further funding will be appropriated for the regulation and oversight of the Colorado pesticide industry.

NPMA and the Colorado Pest Control Association are working closely with industry partners and the Colorado Department of Agriculture to pass S.B. 119 expeditiously. Please contact abray@pestworld.org if you have any questions or can offer any assistance.

Colorado - Boulder Neonicotinoids Ban

Recently the city of Boulder has responded positively to proposed resolution that would ban the use of neonicotinoids (neonics) on city property. The resolution would require the city to:
  • not use neonics on city properties;
  • urge all levels of government to suspend the use of neonics until they have been properly reviewed and found safe;
  • urge all businesses, homeowners and HOAs to take immediate steps to ensure that plants and seeds that are sold and used in the city do not contain neonicotinoids; and
  • support and actively engage in education efforts and encourages others to adopt similar policies.

A public hearing concerning the resolution is scheduled for May 5. NPMA is working closely with the Colorado Pest Control Association and other key industry stakeholders to represent the industry that the public hearing.

Maine Hearing on Several Pesticide Related Bills

On Thursday, April 16 at 1 p.m. the Joint Standing Committee on Agriculture, Conservation and Forestry will be having a hearing concerning several bills that could have an impact on our industry.(H. 758, H. 759, H. 766, H. 767.) On April 9, NPMA members participated in a coalition meeting in Maine to coordinate and collaborate testimony at the April 16th hearing. NPMA continues to work with allied industry associations and assist NPMA members in Maine.

Methyl Bromide Incident: Industry Talking Points

According to published reports, in March 2015 a Delaware family was admitted to the hospital after becoming ill while on vacation at a rental property in the U.S. Virgin Islands (U.S.V.I). They were airlifted to the United States mainland for continued treatment. The mother has been released and the father and two teenage sons remain in critical condition.
