Efficacy of Pheromone Traps to BMSB

A large research team, led by Dr. Tracy Leskey of the USDA-ARS Appalachian Fruit Research Station, recently published research that evaluated a the use of a trap baited with a two component aggregation pheromone against the brown marmorated stink bug (Halyomorpha halys) across the mid-Atlantic and northeastern United States. The aggregation pheromones were used as a lure and inserted into black pyramid traps, either as a standalone attractant or in conjunction with a synergist (methyl (2E, 4E, 6Z)-decatrienoate (MDT)), to monitor seasonal abundance of BMSB in and around agricultural production areas. Adult and nymphal BMSB were attracted to the traps throughout the trial, which ran from mid-April to mid-October in consecutive years. Trap catches were highest when the synergist was used and there was a seasonal peak in early September. The brown marmorated stink bug is an invasive species and a major occasional invader throughout most of the United States.

This paper was published in the most recent volume of the journal Environmental Entomology under the title, ”Attraction of the invasive Halyomorpha halys (Hemiptera: Pentatomidae) to traps baited with semiochemical stimuli across the United States”

CLA/RISE: Bringing the Label to Life Workshop
NPMA
In late April, NPMA staff participated in a workshop held in conjunction with the CropLife America and RISE spring conference in Crystal City, VA. The purpose of the event was to interact with, and answer the questions of, employees of the federal agencies, primarily EPA. NPMA exhibited on behalf of the structural pest management industry and provided hands-on demonstrations of a variety of pest management gear, including application equipment, monitoring tools, and personal protective equipment. The event was a great success as NPMA was able to explain structural pest management principles and practices to those who regulate our industry at the federal level and continue to build on existing relationships with many prominent regulatory officials.

A special thank you to Sylvia Kenmuir and Target Specialty Products for assisting NPMA with this event.

APHIS/AQI Pending User Fee Rule: Update

On April 27, Rep. Frederica Wilson (FL-24) penned an op-ed in the Miami herald urging the withdraw of the pending Agriculture Quarantine Inspection (AQI) rule proposed by the Animal Plant Health Inspection Service (APHIS). NPMA has been working closely with Rep. Wilson’s office and also leading a large coalition to significantly alter the APHIS/AQI rule. The APHIS/AQI rule was submitted to the Office of Management and Budget (OMB) in January 2015. The NPMA coalition subsequently met with OMB to express concerns over the rule, and the lack of stakeholder engagement.

NPMA recently spoke with an APHIS official and was informed that OMB has reached-out to APHIS an abnormally high number of times over the past two months, asking questions and expressing some concerns over the rule. Mere speculation suggests that there remains the possibility that OMB will require APHIS to re-write the rule based on the indications that they have some problems with the rule and how APHIS determined some of the fees.

Legislative Action to Stop EPA Waters of the U.S. Rule

In anticipation of the forthcoming Environmental Protection Agency (EPA) Waters of the U.S. (WOTUS) rule, opponents are moving to enact legislation to stop the implementation of new water regulations that could have far reaching and negative implications across several industries.

In The U.S. House of Representatives two separate bills are being supported by opponents of the EPA rule. H.R. 897 which would ban National Pollutant Discharge Elimination System (NPDES) permits for pesticides that are already registered under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and H.R. 1732 which require the EPA to withdraw WOTUS and rewrite any regulation with more stakeholder involvement.

In the U.S. Senate the Federal Water Quality Protection Act was introduced. The act would require EPA to revise the definition of WOTUS prior to moving forward with any final clean water rule. Additionally, NPMA is part of a large coalition that is aggressively lobbying for proposing legislation via an amendment that would exempt FIFRA registered products from NPDES permits, mirroring H.R 897.

Wood Destroying Insects: HUD Inspection Forms and Map Update

The HUD-NPMA-99A and HUD-NPMA-99B forms expired on April 30. Due to the Federal regulatory process, HUD-NPMA-99A and HUD-NPMA-99B will remain valid for up to one year after the stated expiration date, or until the Office of Management and Budget (OMB) reissues the forms with a new expiration date. Please read a guidance document here, which explains HUD-NPMA-99A and HUD-NPMA-99B continued viability. This document can accompany the forms and should be used as guidance for all interested stakeholders.

Additionally, the U.S. Department of Housing and Urban Development (HUD) will no longer use the map created by the U.S. Forest Service to determine the need for inspections. In March 2015, HUD published their Single Family Housing Policy Handbook (SF Handbook; HUD Handbook 4000.1), which identifies areas that are exempt from inspection. Click here to review HUD’s Termite Treatment Exception Area’s, which provides a detailed list of exempted states and counties. States that are not listed and have historically required termite inspection reports still require termite inspection reports for all new construction.

Democrats Push to Raise the Minimum Wage

The Department of Labor and Congressional Democrats are pushing to raise the minimum wage to $12 and hour by 2020. The Raise Wage Act was introduced on April 30. The Raise the Wage Act would initially raise the minimum wage to $8 an hour, followed by $1-increases each year after that until it reaches $12 in 2020. The Democrats are in the minority in both the Senate and House of Representatives, but the Department of Labor is expected to propose new rules relating to wages and overtime sometime in 2015, and the administration has strongly endorsed Congressional action to raise the minimum wage.

NPMA will continue to monitor legislative and regulatory activity concerning wages, and are prepared to actively engage both Capitol Hill and the Department of Labor on this issue.

Colorado S. 119, Reauthorization of the Colorado Pesticide Applicator Act

On April 27, S. 115 passed the full House and has been sent to conference between the Senate and House, which is expected to be contentious. S. 115 originated and passed the Senate earlier this legislative cycle and finding a compromise between the Senate and House versions of S. 115 will involve compromise. S. 115 passed the Colorado House with several amendments. The amendments include; adding 2 additional members to the Advisory Committee, additional training requirements for applicators, internet access to finalized enforcement actions against pesticide violations, and shortening the Sunset review provision from 9 to 7 years.

CPCA and NPMA have been and will continue to work closely with key stakeholders on the passage of S. 115 before the end of the Colorado legislative session May 6. If a compromise on S. 115 cannot be reached, the Colorado Pesticide Applicator Act will not be reauthorized and the EPA will be forced to play the role of regulating the pesticide industry in Colorado, which will not be possible with EPAs limited regional resources.
