APHIS Proposes Fee for Overseeing Pest Treatments
The U.S. Department of Agriculture's Animal and Plant Health Inspection Service (APHIS) recently proposed rulemaking establishing a new Agricultural Quarantine Inspection fee for APHIS personnel overseeing fumigations and other pest treatments of regulated commodities. While the proposal imposes the $375 per treatment fee on importers, it also mandates that the fumigator collect the fee and remit it to APHIS. A separate but related rulemaking increases overtime fees for APHIS personnel by 40 percent. Collectively, the proposals would assess at least $700-$800 in fees for most import fumigations. Notable Bills Moving Through CA Legislature
The California Senate last week passed legislation extending the statutory authority of the Structural Pest Control Board from Jan. 1, 2015 to Jan. 1, 2019. Senate Bill 1244 also defines a number of terms, deletes obsolete provisions pertaining to the definition of fumigants and fumigation procedures, and authorizes, in specified circumstances, waiving the use of warning agents in conjunction with fumigants. Meanwhile, the California Assembly last week approved a measure requiring the Department of Pesticide Regulation (DPR), by July 1, 2018, to issue a determination with respect to its reevaluation of neonicotinoid pesticides. Assembly Bill 1789 requires DPR, on or before two years after making this determination, to adopt any control measures necessary to protect pollinator health. The bill also requires DPR to submit a report to the appropriate committees of the Legislature if DPR is unable to adopt those control measures and to update the report annually until the department adopts those control measures. Pollinator Training Bill Introduced in NJ
A measure requiring persons seeking certification and licensing as a pesticide applicator or a commercial pesticide operator to complete a continuing education or training course concerning the impact of pesticides on pollinating bees was introduced last week in the New Jersey Assembly.
Minnesota Gov. Dayton Signs Pollinator Insecticide Bill
Minnesota Governor Mark Dayton last week signed legislation into law prohibiting labeling or advertising an annual plant, bedding plant, or other plant, plant material, or nursery stock as beneficial to pollinators if the annual plant, bedding plant, plant material, or nursery stock has been treated with and has a detectable level of systemic insecticide that: (1) has a pollinator protection box on the label; or (2) has a pollinator, bee, or honey bee precautionary statement in the environmental hazards section of the insecticide product label.
Under House File 2798, the term "pollinator lethal insecticide" is defined as an "insecticide absorbed by a plant that makes the plant lethal to pollinators. Pollinator lethal insecticide includes, but is not limited to, the neonicotinoid class of insecticides that affect the central nervous system of pollinators and may cause pollinator paralysis or death."
