Miranda Rights Warning Could Get Rewrite

The Supreme Court on Dec. 7 seemed headed toward telling police they must explicitly advise criminal suspects that their lawyer can be present during any interrogation. The arguments in front of the justices were the latest over how explicit the Miranda warning rights have to be, as justices debated whether the warnings police gave Kevin Dwayne Powell made clear to him that he could have a lawyer present while being interrogated by police. More




Record Year By Far for Marijuana Busts Along Arizona Border

Whether in big or small packages, or at or between ports of entry, marijuana seizures continue to become a more frequent occurrence along Arizona's stretch of U.S.-Mexico border -- the busiest on the Southwest border for such seizures. The 1.6 million pounds seized by Arizona law enforcement in 6,939 incidents in the recently completed fiscal year 2009 shattered all previous records, nearly doubling the 2005 fiscal year total, show figures from the Arizona High Intensity Drug Trafficking Area, or HIDTA. More


Thousands Remember Four Officers at Memorial Service

Thousands of officers from across North America came to Washington state to honor four Lakewood Police officers who were gunned down in a coffee shop. A procession of 2,000 cars followed the flag-draped caskets of Sgt. Mark Renninger and Officers Ronald Owens, Tina Griswold, and Greg Richards to the Tacoma Dome, where the three-hour service was held before 20,000 mourners. More




Man Accused In 2006 Shooting Caught At Border

A 37-year-old man is in custody and accused of fleeing the country after shooting a man in the stomach during an attempted robbery in Spring Valley more than three years ago, authorities said. Jorge Mendoza Guitterez was arrested Dec. 7 on suspicion of assault and robbery charges in connection with a March 2006 shooting, according to San Diego County sheriff's Detective Monica Sanchez. Guitterez was arrested as the U.S./Mexico border as he was entering the United States, Sanchez said. More

When Atlanta Police Chief Richard Pennington announced he would resign at the end of the year, his decision wasn't entirely a surprise. Both candidates for mayor in this week's runoff election had vowed to overhaul the police department, saying high profile crimes in the city jeopardized public safety. Pennington's departure, announced last week after seven years at the helm, has significance beyond Atlanta's borders: It is the latest in an exodus of at least half a dozen big city police chiefs this year. Some of the nation's best known local law enforcement figures have announced their retirements and resignations in Atlanta, Los Angeles, San Francisco, Miami, Dallas and Seattle. Their exits signal that an important era in U.S. policing is nearing an end, some analysts say. More

A backlog of disciplinary cases is forcing San Francisco Police Chief George Gascón to play "Let's Make a Deal" with errant cops -- offering passes for offenses that under ordinary circumstances could get them fired. The chief figures he has to do something, having inherited a mess when he came on the job in July in which some officers' disciplinary cases had lain dormant for years. More

Prison Population Growth Slows in 2008

The U.S. prison population edged up slightly last year, though the number of total inmates dropped in 20 states, including New York, Georgia and Michigan. Justice Department figures released recently show the overall state and federal prison population stands at a record 1.6 million and is still rising, but the rate of growth is slowing as state authorities look for cheaper ways to mete out justice. More

A part-time EMT arrested last recently on larceny and obstruction of justice allegations now faces multiple drug and weapon charges after police found a cache of firearms, thousands of assorted prescription pills, a tear-gas launcher and a military-grade rocket launcher -- all inside his Rockport apartment. Police had sought the warrant suspecting that Atkinson -- whose license to carry a gun was suspended last week off the original felony charge -- failed to relinquish all of his firearms the first time around. That, police said, came after officers noticed he had handed in ammunition for guns that he had not turned over. More

Texas Wheelchair Escapee Caught

A Texas inmate who escaped recently -- on foot even though he was thought to need a wheelchair -- has been recaptured, the U.S. Marshals Service said Dec. 7. Arcade Comeaux Jr., 49, was carrying two loaded pistols when he was arrested without incident at 7:40 a.m. at a business in Houston, Texas, said U.S. Deputy Marshal Alfredo Perez. "[Comeaux] was cold, wet, tired and hungry. He had had enough," Perez said. "He was tired of running." More
