Border Sheriffs Get Federal Funding

A $446.8 billion spending bill for various
federal agencies, passed by the House on Dec. 10, includes $4.8 million in funding for county sheriff's departments along the U.S.-Mexico border. The funds were tucked into the bill by Sen. Kay Bailey Hutchison, R-Texas. She said the money would be used to pay for overtime, hire additional personnel and purchase equipment. "Not only will it increase the number of deputies patrolling the border, but it will enable sheriffs and deputies to keep watch for longer, and with better equipment,"

The Los Angeles County Board of Supervisors has agreed to merge county police with the Sheriff's Department. Employees of the Office of Public Safety are responsible for security at more than 450 county facilities, including hospitals and
parks. Those employees will now have the opportunity to qualify as sheriff's deputies or work in non-sworn positions within the department. County staffers indicated that the plan is to absorb existing county police staff into the sheriff's department, but they cannot guarantee jobs for all in the merger, planned to take effect June 30, 2010.

Court Will Rule on Privacy of Text Messages sent on Employer-owned Devices After Officer Appeals

The Supreme Court said it would rule for the first time on whether employees have a right to privacy when they send text messages on electronic devices supplied by their employers. The justices agreed to hear an appeal from a police department in Ontario, Calif., that was successfully sued by Sgt. Jeff Quon and three other officers after their text messages -- some of which were sexually explicit -- were read by the police chief.
Last year, the U.S. 9th Circuit Court of Appeals broke new ground by ruling that the police officers had a "reasonable expectation of privacy" in their text messages. The officers had been led to believe by a supervisor that the devices were also for personal use, the appeals court said.

An attorney for a Georgia police officer who was fired for a Facebook posting says what happened to his client could happen to anyone. "Not only is it a censorship issue that everyone needs to know about," said Mike Puglise. "They are not only saying that you can't write it, but also that they can interpret what the content means." O.J. Concepcion,
33, of Morrow says he was fired from a job he held for nearly four years because of comments he posted on the social networking Web site Facebook. Some of those posts included details about his police work, he said, such as the fact he was working with the FBI on a drug case.

Jails Cut Costs, Boost Security by Limiting Inmates' Mail

A growing number of the nation's jails are restricting inmates' incoming mail to postcards to save money and bolster
security. At the Marion County Jail in Oregon, the postcard policy is expected to reduce annual mail-sorting expenses by at least half -- about $30,000 -- says Sheila Lorance, a lieutenant in the county sheriff's office. She says 15 other jails in the state are also considering it.

Police officers must obtain a search warrant before searching the contents of a suspect's cell phone unless their safety is in danger, a divided Ohio Supreme Court ruled Tuesday on an issue that appears never to have
reached another state high court or the U.S. Supreme Court.
The court ruled 5-4 in favor of Antwaun Smith, who was arrested on drug charges after he answered a cell phone call from a crack cocaine user acting as a police informant. During his trial, Smith argued that the evidence obtained through the cell phone search was inadmissible because it violated the constitutional ban on unreasonable search and seizure.

Police said a Boston man wanted for drug trafficking tried to hide his identity by cutting off his fingertips. State Police
spokesman David Procopio said Dec. 14 that Francis Viliar admitted to police that he paid someone $400 to slice off the fleshy pads at the ends of his fingers.During booking, officers discovered that his fingertips were covered in scar tissue.

Obama Orders Illinois Prison to House Detainees

President Obama ordered the federal government on Tuesday to acquire a prison in northwestern Illinois to house some terrorism suspects now being held at Guantánamo Bay, Cuba, in a major step toward shutting down the
military detention center. In a letter addressed to Gov. Patrick J. Quinn of Illinois, the administration said that it would acquire the Thomson Correctional Center, a maximum security prison in a rural village about 150 miles west of Chicago, for a "limited number" of detainees who are currently housed at Guantanamo Bay.

Wisconsin Prison Population Declining

There are fewer inmates in Wisconsin prisons for the first time in many years. The latest statistics show a five percent drop in the prison population between 2007 and 2008. The U.S. Bureau of Justice Statistics report released this week puts Wisconsin in the top ten states that have seen prison numbers drop. At the end of 2008
the state had 2000 less prisoners than the year before. A thousand fewer people were sent to prison and about 500 more were released.
