Radiology Hot Topics is a biweekly poll that is disseminated to the membership through the RBMA RadCast and the RBMA website. Each online poll consists of one question on a topic of general interest; respondents are directed to current results when they submit their response. Final results, including a written analysis, are posted on the RBMA website in PDF format.

If you have a question you would like to ask the RBMA membership, email your submission to RBMA's research associate, Cynthia Vervena, at cynthia.vervena@rbma.org. Each submission should be one question with closed-ended, single- or multiple-choice response options.

What does DOMA's (partial) demise mean for your benefit plans?

On June 26, the U.S. Supreme Court announced its decision in United States v. Windsor, declaring unconstitutional Section 3 of the Defense of Marriage Act (DOMA) which defines "marriage" for purposes of all federal laws as the marriage between one man and one woman. As a result, for purposes of federal law, including the Internal Revenue Code and ERISA, a same-sex couple who are legally married under state law must be treated as married for federal purposes.

Legal and regulatory implications of attaining meaningful use

The federal meaningful-use program has, at last estimate, garnered the participation of 4,500 radiology professionals, and incentive payments of nearly $1.5 billion are still on the table for eligible diagnostic-imaging professionals. Groups that begin the attestation process by Oct. 3 can receive up to $39,000 per eligible provider, and as adoption grows among their referring-physician bases, more and more radiology practices are expected to participate.
