NCTA: Carriage, access, rate regulations should go

Data from 2010 just adds to the growing body of evidence that the multichannel video marketplace is increasingly competitive and that any regulations adopted when it was otherwise — as in the
1992 Cable Act — now need to be shown the door, as it were. That is according to the National Cable & Telecommunications Association's supplementary filing in the Federal Communication Commission's video competition report, which says the FCC should tell Congress that the 1992 Act regulations, are no longer necessary to protect consumers or jump-start competition. It also argues that the remaining basic-tier rate regulation should go the way of the rest of the rate regulations, which
were scrapped in the 1996 Communications Act rewrite. More

Spectrum incentive auctions proposal clears Senate committee

Wireless carriers and TV broadcasters — and by association the cable industry — were tuned in when the Senate Commerce Committee released its marked up version of a bill that authorizes incentive auctions of broadcast spectrum. While the bill, which passed 21-4, allocates a valuable block of airwaves to public safety agencies and funds a nationwide network for first responders, the telecom community was more interested
in its implications for broadcasters, mobile carriers and, in the end, cable operators because it encourages broadcasters to relinquish "unused" spectrum for wireless auctions. While the broadcasters would reap financial rewards from the auctions, there has been mixed reaction about participating.

American Cable Association members — generally small independent cable operators — "pay disproportionately higher prices for video content" because TV stations and national cable networks
"routinely abuse their market power," ACA President and CEO Matthew M. Polka said in comments aimed at the Federal Communication Commission's upcoming report on the status of competition in the video delivery space. ACA members have long railed that their smaller status allows stations and network content providers to charge more per subscriber than what the giant MSOs pay: "About 30 percent more on average for national cable programming," the organization said in its appeal to the FCC.

The cable business isn't going to cede its share of the broadband market by waiting around for coaxial cable to become obsolete, and now those providers won't have to make an expensive transition to a fiber-to-the-home infrastructure to achieve gigabit networks. Cable equipment provider Arris has demonstrated that it can deliver speeds of up to 4.5 gigabits per second by upgrading the existing cable broadband networks. Today's cable
networking technology, known as DOCSIS, currently is deployed by providers such as Comcast in a version known as DOCSIS 3.0, and ISPs are using it to deliver up to 200 Mbps downstream. But Arris has upped the ante by allocating more channels for broadband and bonding them together, enabling speeds of up to 4.5 Gbps downstream and 575 Mbps up.

Bloomberg files complaint against Comcast with FCC

As promised, Bloomberg officially has asked the Federal Communications Commission to require Comcast to move Bloomberg Television into "existing news
neighborhoods" on its systems, saying that not to do so violates a condition in the FCC's order approving the NBCU deal. In a complaint filed June 13, Bloomberg said that Comcast's assertion that it does not have such neighborhoods and that any "neighborhooding" requirement applies to any future such possible news is off base.

Maryland leaders celebrate federal dollars for broadband

Many of the leading members of Maryland's political class — including Democrats Gov. Martin O'Malley and Sen. Barbara A. Mikulski — converged June 13 in a nearly empty warehouse in Howard
County to celebrate some federal stimulus funding that is continuing to flow to the state. A $115 million federal grant is being used to expand broadband access throughout Maryland. June 13's event marked the opening of a "logistics center" in Elkridge that will serve as the beachhead for a 10-jurisdiction consortium, including Montgomery and Prince George's counties, that is slated to receive the bulk of the federal money.

Wisconsin public Internet fights telecom attempts to kill it off

The University of Wisconsin's Internet technology division and a crucial provider of Internet access for Wisconsin's educational system are under attack from that state's legislature and from a local telecommunications association. At issue is the WiscNet educational cooperative: The nonprofit provides affordable network access to the state's schools and libraries, although its useful days may be numbered unless the picture changes
soon. Under a proposed new law, the University of Wisconsin system could be forced to return millions of dollars in federal broadband grants that it already has won, spend far more money on network services, and perhaps even withdraw from the Internet2 project.

Time Warner Cable agreed to acquire NewWave Communications' cable systems in Kentucky and western Tennessee for $260 million. Under the deal, expected to close in the fourth quarter, Time Warner
will add about 70,000 basic video subscribers, 42,000 Internet subscribers and 26,000 phone subscribers.

Midcontinent Communications is purchasing the Minnesota and Wisconsin cable systems of US Cable. The systems pass approximately 86,000 homes and serve approximately 33,000 customers. Ninety percent of the US Cable customers are served by a fiber network, fed from a single cable headend.

A pair of top cable engineers — Jay Rolls, senior vice president of technology for Cox Communications and Kevin McElearney, senior vice president of network engineering for Comcast — see the move from IPv4 to IPv6 as a challenge that can be overcome. But not without some bumps along the way. "The interesting thing about the v6 transition is that we can do all we want to prepare for that but it's really an entire
ecosystem. There's a lot of interdependence between the operators and the other people offering services on the Internet ... and there will be some bumps on the road; we foresee that for sure," said Rolls, speaking as part of a webcast introducing Cisco's upgraded line of ASR 9000 service routers. McElearney even took issue with the thought that the industry is transitioning to IPv6.
