Obamacare Provision Could Force Government Shutdown
On Sept. 19, the House passed a continuing resolution (CR) (H. Res. 352) that keeps the federal government in business for nearly three months (until Dec. 15), while defunding the Affordable Care Act (ACA or "Obamacare").
Inclusion of the defunding provision was largely a political statement by House conservatives. Senate Majority Leader Harry Reid (D-Nev.) is expected to remove the controversial language before a vote this week.
The House then has until Sept. 30 to approve this measure or shut down non-essential governmental operations. House Republican leadership has been unsuccessful in urging its caucus to postpone Obamacare defunding consideration until Congress addresses the debt ceiling.
Although air traffic control systems would remain open, a government shutdown will undoubtedly wreak havoc on the aviation industry. During the Federal Aviation Administration's Aug. 2011 shutdown, 4,000 employees were furloughed, resulting in worldwide certification and inspection delays.

NTSB Rule Changes Aviation Certificate Enforcement Appeals
On Sept. 19, the National Transportation Safety Board (NTSB) issued a final rule implementing several changes to its Rules of Practice governing aviation certificate enforcement appeals.
The board's latest move is in response to public comments on an NTSB-issued interim final rule (IFR) following the enactment of the Pilot's Bill of Rights (Pub. Law 112-153). This law, among other mandates, requires the Federal Aviation Administration (FAA) to disclose its enforcement investigative report (EIR) in cases challenging a holder's certificate.
Under the IFR, a certificate holder is permitted to submit a motion dismissing an FAA complaint if the agency does not disclose releasable portions of its EIR. The final rule outlines ten substantive comments the NTSB received in response to the IFR.
The NTSB also issued a proposed rule to address its recommendation extending the EIR availability requirement in the Pilot's Bill of Rights for emergency enforcement cases.

ARSA Mourns Loss of Lynn Fortner
Last Friday, Lynn Fortner, a long-time supporter of ARSA, passed away. For 50-years, he served in a variety of management positions within the aviation industry, including Parker/Bertea, Flight Accessory Services, Hawker Pacific, A. Biederman, Fortner Engineering, and Fortner Accessory Services. Fortner was also a vocal advocate of the association's political action committee, ARSA PAC.
"On behalf of ARSA and all its members, we pass along our deepest condolences to the Fortner family," stated ARSA Executive Director Sarah MacLeod. "Lynn was a steadfast member of this association and will be sorely missed."

Airport Authority Board Pushes through Plans for New Hangar

A potentially testy situation involving a planned expansion and long-term commitment of Ascent Aviation Services Corp. at Tucson International Airport appears to have been resolved when the Tucson Airport Authority board of directors agreed to a resolution encouraging the management of the authority change its construction standards to allow for a new hangar to be built on the west side of the airport.
