As 2014 comes to a close, the Aeronautical Repair Station Association would like to wish its members, partners and other industry professionals a safe and happy holiday season. Legal Brief — "Seriously" Be Ready for New Rule Implementation
From Oct. 29: While ARSA is confident the agency will correct its "serious" misstep, our diligence requires us to inform members of their options if the problem is not addressed before the rule is implemented. From a business standpoint, there are two options: attempt to comply with the new requirement, or simply comply with the current rule until the agency issues the correction and/or guidance to its employees on the matter.

FAA: OEMs Can't Dictate Where Repairs Are Done

From April 16: FAA has reiterated that manufacturers cannot specify where inspections and other mandatory work on their products is performed, but left open the question of what fair compensation is for the proprietary maintenance instructions that a repair station may need to do the work.

ARSA Works: FAA Clarifies Contested FSDO Policy
From April 16: On April 7, the FAA responded to a January 17th letter sent by ARSA to the North Texas Flight Standards District Office (FSDO) contesting the requirement that requests for action be submitted in hard copy.

FAA, EASA Release MAG Revision
From Feb. 12: On Jan. 29, 2014, the fourth revision to the Maintenance Annex Guidance (MAG) was released. The MAG, originally issued on May 3, 2011, provides detailed guidance for FAA-certificated repair stations located in the U.S. to obtain an EASA certificate (and vice versa) under the US/EU Aviation Safety Agreement.

ICA: FAA Legal Interpretation Addresses DAH Responsibilities
From April 16: On March 31, the FAA released a legal interpretation in response to a Piedmont Propulsion Systems request regarding the responsibilities of a design approval holder (DAH) to make available Instructions for Continued Airworthiness (ICA) for mandatory inspections and repairs.

FAA Agrees with ARSA that Line Maintenance can be Major
From July 30: In a quick turnaround, the Aircraft Maintenance Division responded within two days to ARSA's question about airframe-rated repair stations with line maintenance authorization performing major repairs and alterations. The agency agreed with the association's interpretation that the CFR's definition of line maintenance does not imply a prohibition against non-specified activities.

Draft Revision to Order 8130.2 Released
From Jan. 15: On Jan. 6, 2014, the Federal Aviation Administration (FAA) released a draft revision to Order 8130.2. This draft proposes changes to the current order, 8130.2G Change 1, which established procedures for accomplishing original and recurrent airworthiness certification of aircraft and related products and articles. The procedures apply to FAA manufacturing aviation safety inspectors (ASI), to airworthiness ASIs, and to private persons or organizations delegated authority to issue airworthiness certificates and related approvals. Public comments on the proposed changes are due to the FAA by Feb. 7, 2014. Stay tuned for further ARSA analysis, commentary, and guidance on this draft revision.

FAA Releases Order 8300.16
From May 7: On April 18, the FAA released order 8300.16 — Major Repair and Alteration Data Approval. The release comes at the end of an extensive process in which ARSA was actively engaged.
