Federal safety officials have added, through mid-April, 21 new construction-industry cases to the Occupational Safety and Health Administration's Severe Violators Enforcement Program, according to a tabulation made by ENR.
About 60 percent of the 520 or so companies that OSHA has placed in the program are construction-related, reports Business Insurance, an industry publication. Listing in the program subjects employers to stepped-up inspections and enforcement. OSHA also issues critical press releases about the companies in the program, a practice some employer attorneys have described as public shamings.

Many employers implement post-accident drug and alcohol testing policies to promote workplace safety, as part of accident investigation efforts, and in the hope of reducing workplace accidents and workers' compensation claims.
But for those employers, the legal landscape may have shifted on May 12 when the Occupational Safety and Health Administration published its final rule on electronic reporting of workplace injuries and illnesses.
According to Dale Deitchler, a shareholder at Littler Mendelson, the employment law firm, the new rule increases an employer's obligation to ensure that employees report work-related injuries and illnesses.

Critics of OSHA's recently released recordkeeping rule, which would make worker injury and illness data public, voiced their concerns during a May 25 hearing convened by the House Workforce Protections Subcommittee.
The rule, Improve Tracking of Workplace Injuries and Illnesses, was published May 11. It states that establishments with 250 or more workers must electronically submit to OSHA – on an annual basis – information from their OSHA Forms 300, 300A and 301. Establishments with 20 to 249 workers in certain high-hazard industries will have to submit information from their annual summary form, OSHA Form 300A. The agency will then make information available on its website in a searchable database.
