The Home Depot Inc. on Monday, June 1, asked a federal court to dismiss the lawsuit filed by consumers claiming they were hurt by the company's massive data breach.
"All of the claims alleged in the complaint suffer from the same fatal defect found in the vast majority of other breach cases ... they have suffered no actual or imminent economic injury that is fairly traceable to Home Depot's alleged conduct," the company says in its filing.

U.S. construction spending surged in April to the highest level in nearly 6-1/2 years as outlays increased broadly, pointing to some pockets of strength in the economy.
Construction spending jumped 2.2 percent to an annual rate of $1.0 trillion, the highest level since November 2008, the Commerce Department said recently. The percent increase was the largest since May 2012.

Construction employment expanded in 232 metro areas, declined in 66 and was stagnant in 60 between April 2014 and April 2015, according to a new analysis of federal employment data released recently by the Associated General Contractors of America. Association officials said even as contractors in many parts of the country continue to expand their payroll, many firms remain concerned about the potential impacts of federal transportation funding shortfalls.
