The Texas Association of Builders is set to host its committees and Board of Directors meetings along with a HOMEPAC fundraiser this week in Austin. TAB's committee meetings will be held on March 21-23 at the Driskill Hotel, while the HOMEPAC fundraising event will take place at TopGolf on March 22. To attend, you must register online. These fundraisers help support pro-housing candidates and incumbents for both statewide office and the Texas Legislature. This event was a huge success in 2016 (photo gallery)! Tickets can also be purchased online while registering for committee and Board of Directors meetings. Membership is the life-blood of the Texas Association of Builders and its 27 local home builders associations across the state. A strong, vibrant membership has a powerful impact on the association's goals. These include advocating for or against legislation, raising awareness and educating the public on the residential construction and land development industry, and promoting the value of a strong housing industry and its economic impact to the Texas economy, to name a few!

For several years, Texas has lead the nation in housing starts — we have the strongest housing market in the nation — but those numbers are not reflected in TAB's membership numbers. Last year, the Texas Association of Builders was awarded a $50,000 grant from the National Association of Home Builders to hold a membership drive facilitated by an outside membership marketing group. In order to receive the grant, TAB committed another $25,000 to this initiative. This $75,000 will be used to help off-set the costs associated with hiring Rob and Kate Oliver (The Oliver Group) to train our members on the DIRECTDrive approach to membership recruitment and retention.

We need every one of you to commit to participating in the training workshop in your area and, more importantly, to showing up at your local home builders association May 23 and/or 24 to give at least two hours of your time to recruit new members. The trainings will provide you with all the tools you need to have a successful drive. And, although it is not realistic that every member will attend a training workshop, your HBA staff and leadership will help you use the DIRECTDrive method to assist your HBA in growing its membership.

Texas Commission on Environmental Quality
The TCEQ Commissioners renewed the general permit to authorize stormwater discharges from construction sites and it became effective Mar. 5. Current holders of expired permit authorizations have 90 days from the effective date to submit a renewal Notice of Intent (NOI) or Low Rainfall Erosivity Waiver (LREW). Submit renewals online or with a paper form. The 90-day grace period ends June 3.

Changes to the general permit include:
  • added and revised several definitions to clarify permitting requirements;
  • added clarification regarding redacted signatures for small construction site notices and secondary operator site notices for large construction sites;
  • revised the Total Suspended Solids benchmark monitoring level for concrete batch-mixing plants;
  • clarified the requirements of primary operators of large construction activities related to Stormwater Pollution Prevention Plan (SWP3) development and implementation; and
  • added the requirement that effective Sept. 1, 2018, all NOIs, Notices of Change (NOCs), Notices of Termination (NOTs), and LREWs will be required to be submitted to the TCEQ electronically via the STEERS/ePermits system.

The federal 45L tax credit offers a $2,000 tax credit to builders who build and sell energy efficient homes. Previously the credit had expired on December 31, 2017. The recently passed budget legislation that was passed by Congress and signed into law by President Donald Trump extended the credit retroactively for 2017.

RESNET staff has been working with Republican and Democratic staff of the Senate Finance Committee on the status of the 45L tax credit. It was a very complicated issue with many moving parts. The legislation passed by the Senate was offered by Finance chairman Oren Hatch, R-Utah, that extended the credit for 2017 and 2018.

The House version had no extension. Due to the disagreements between the House and the Senate a deal was cut between Senate Majority Leader Mitch McConnel, R-Kentucky, and House Speaker Paul Ryan, R-Wisconsin. The final deal was that the 45L credit would only be extended for 2017.

This was only a straight extension of the credit, no other changes were made. Builders whose homes were sold in 2017 can go back and work with their HERS Raters in producing the tax credit compliance calculations and reports to receive the credit. RESNET has informed the accredited HERS Rating Software programs of these changes.

In RESNET staff's discussions on Capitol Hill it appears that there is an appetite for a discussion after this session about an updated version of 45L that would be updated and on a longer term basis.

In addition, RESNET staff has been able to glean information on the 2019 budget request by President Trump that was released recently. It must be remembered that the budget released and is in the media is for fiscal year 2019. Congress still has not passed the agency appropriations for fiscal year 2018.

The president's 2019 proposal is for draconian cuts to DOE's energy efficiency programs, eliminating the EPA's Water Sense program and funding EPA's ENERGY STAR programs through "user fees." The word we received on Capitol Hill and the media is that the Senate is considering the president's 2019 budget proposal problematic.

The House and Senate have passed different versions of the 2018 budget and are expected to go to conference reconciliation in early March. The 2019 budget will have to go through the House and Senate budget process which will take a while.
