In his last lap around the state before Tuesday's election, Rick Perry exuded confidence but cautioned that "this election is far from over." At the private air terminal at Dallas Love Field, his campaign plane was parked alongside the jet of White, who also was in Dallas making the last frenzied get out the vote rallies. The campaign for some candidates won't end with Tuesday's election, and could be taken over by lawyers who already are preparing for possible recount battles. The large number of too-close-to-call congressional races in states like Colorado, Nevada, Illinois and West Virginia has some observers predicting more contested elections and recounts this year. Lawyers in the Tom DeLay conspiracy trial argued about whether DeLay's activities during the 2002 elections were illegal acts or just good politics. In opening remarks to a jury of six women and six men, Travis County prosecutor Beverly Mathews said DeLay conspired to launder "dirty" corporate money into donations to candidates, a violation of Texas law. She said that the exchange was part of DeLay's "larger, clever scheme" to change the face of the state's representation in Congress. Dick DeGuerin, DeLay's lawyer, rebutted, "This case is about politics." More

BP oil spill costs hit $40 billion, drag third quarter profit down

BP PLC says the cost of the devastating Gulf of Mexico oil spill has grown to $40 billion, dragging down its third quarter net profit by more than 60 percent despite higher oil and gas prices. The London-based company said Tuesday it returned to profit for the first time since the April spill, though the $1.79 billion net income was still well below a year-earlier profit of $5.3 billion because it set aside an extra $7.7 billion to pay for the spill response and cover future fines and compensation. And the area continued to produce more than 5 billion cubic feet per day in the first eight months of this year, despite a steep decline in drilling since gas prices crashed in the latter half of 2008, the Powell Barnett Shale Newsletter reports. Las Brisas agrees to lower permit limits for mercury, particulate matter

Las Brisas Energy Center has agreed to lower pollution limits for mercury and tiny dust known as particulate matter. The proposed power plant would agree to mercury limits on its boilers that are less than half of what is included in its draft permit, company attorney John Riley said in court documents. That lower limit would be the same as approved recently for a similar power plant in Matagorda County. More
