Remember that line? Couldn’t we all remember it better? I’m currently on my first vacation (sort of) in about five years. It’s not a total vacation because the husband and I are still getting in some work time (see: writing ASJA newsletter from a charming Pennsylvania inn), but we are traveling away from home for a purpose other than visiting family members, which is amazing. So, under the heading of “do as I say, not as I haven’t entirely managed to do,” breaks are so important. They revitalize your spirit. And you know what, it’s a beautiful time of year. Whether it’s a week, a weekend, a day, an afternoon, please take the time to get away from your desk, your laptop, your phone, take some deep breaths, get outside, appreciate the colors, have a warm beverage (but seriously, what is this apple latte nonsense that’s happening?), take a long walk. Hurricane Season 2022: Writer's Emergency Assistance Fund

We know ASJA members and other professional freelance writers are among those affected by Hurricanes Fiona and Ian. If you or someone you know has had their freelance writing income impacted by these hurricanes, other natural disaster, or illness, the Writers Emergency Assistance Fund is here to help. The application for assistance is here. And if you’re having a good year or simply counting your blessings as you watch the coverage of the hurricane damage, please consider a donation to WEAF. Each year, ASJA grants thousands of dollars to professional writers in need. Our ability to continue this program depends on donations.

Department of Labor Releases New Rule

The Department of Labor released the long-awaited proposed rule on employee or independent contractor classification under the Fair Labor Standards Act. We’ve not yet fully read/processed the 184-page rule, but it argues weighing several factors when assessing worker status, and none of them are necessarily more important than the others. Among the 6 factors: whether the work performed is central to a company’s business; what kind of investments workers make to do their jobs; nature and degree of control; degree of permanence of work relationship; opportunity for profit or loss; skill and initiative. There is a public comment period. We’ll be in touch with ASJA members to share ways to proceed. The NYT has a helpful article with background.

Section 230 heads to the Supreme Court

The Supreme Court announced that it would hear two cases that are looking to chip away at Section 230 legal protections. At the core of one case is the claim that Google’s YouTube service violated the federal Anti-Terrorism Act by recommending videos featuring the isis terrorist group, and that these videos helped lead to the death of Nohemi Gonzalez, a twenty-three-year-old US citizen who was killed in an isis attack in Paris in 2015.
