Supreme Court's Ruling on Gene Patents Opens New Avenues for University Research

Court: Human Genes Cannot be Patented

The U.S. Supreme Court unanimously ruled on Thursday that human genes cannot be patented. But in something of a compromise, all nine justices said while the naturally occurring isolated biological material itself is not patentable, a synthetic version of the gene material may be patented. Legal and medical experts believe the decision will have a lasting impact on genetic testing, likely making varieties more widely available and more affordable.

It supports the encouragement of rapid medical innovation, applied and practical biotechnology, university basic genetic research, collaboration among universities and the medical community and translation of genetic discoveries into tangible medical tests. AUTM believes in the importance of intellectual property protection and remaining competitive with other countries in developing lifesaving technologies.

Stanford University is no stranger to startups. According to one study, Stanford students have gone on to create nearly 40,000 companies since the 1930s. A U.S. patent has been granted to a Kansas State University-developed "candy" that stimulates the growth, health and reproductive functions of cattle, bulls and other livestock. The combination of molasses, oilseeds and oilseed extracts that when heated and evaporated, formed a substance that improves absorption of specific omega-3 fatty acids.
Novel Technology Isolates Unknown Viruses

Researchers at Saint Louis University have developed a way to screen for previously unknown viruses. Their technique involves next-generation genetic sequencing approach called transcriptome subtraction, according to an article published at Biochemical and Biophysical Research Communications.The university has applied for a patent on the technology with the aim of commercializing it.
