Enforcers and Defenders Forum
The 4th Annual Energy Enforcers and Defenders Forum is being held next Tuesday, March 3, 2015 at George Washington University Law School, Lerner Hall (2000 H Street, NW, Washington, DC). All attendees will learn negotiating skills focused on the resolution of agency enforcement proceedings and will be provided an opportunity to engage with senior officials from Commodity Futures Trading Commission (CFTC), Pipeline and Hazardous Materials Safety Administration (PHMSA), Federal Energy Regulatory Commission (FERC), and North American Electric Reliability Corporation (NERC) staff and private practitioners.
Student members of the Energy Bar Association (EBA) will be able to attend this event at no charge, while non-EBA member students can attend for only $10. Academic EBA members will be charged $30, while non-EBA members in the academic field must pay $35.

EBA Secures New Commissioner as Luncheon Speaker
Federal Energy Regulatory Commissioner Norman Bay will serve as the closing night entertainment at EBA’s 2015 Annual Meeting & Conference on Wednesday, May 6, 2015. Commissioner Bay was sworn in to his first term at the Federal Energy Regulatory Commission in August 2014. For five years prior to his confirmation, Commissioner Bay served as the Director of FERC’s Office of Enforcement. Under his leadership, the Office of Enforcement enhanced its ability to conduct market oversight and surveillance and to investigate wrongdoing. Commissioner Bay was a Professor of Law at the University of New Mexico School of Law where he taught Criminal Law, Evidence, and Constitutional Law. He also has previous experience as the U.S. Attorney in the District of New Mexico. The Annual Meeting Dinner and Reception is a great opportunity to "mix and mingle" in an informal setting with the Commissioner and fellow EBA members.

Ohio Supreme Court rules Munroe Falls regulations on oil and gas drilling are improper

The Ohio Supreme Court on Feb. 17 ruled that communities may not exercise their home-rule powers to regulate oil and gas drilling if they conflict with a state law that regulates drilling across Ohio. In its 4-3 decision, the court upheld an appellate court's ruling against the city of Munroe Falls that struck down regulations the community was trying to enforce against a driller, Beck Energy.
How energy-productive is the US?
A new global index commissioned by Philips ranks countries by their energy productivity performance and finds the U.S. in 38th position, trailing the likes of Japan and Germany. The "2015 Energy Productivity and Economic Prosperity Index — How Efficiency Will Drive Growth, Create Jobs and Spread Wellbeing Throughout Society" report — authored by Ecofys, the Lisbon Council, and Quintel Intelligence — sheds light on the tremendous potential of improved energy productivity for "rais[ing] economic performance and extend[ing] significant environmental and social benefits" to societies.
Gas vapor eyed as factor in West Virginia oil train fireball
Federal investigators will examine whether pressurized gas played a role in the massive blast that followed the derailment of a train carrying crude oil through West Virginia this week, the U.S. Transportation Department said Feb. 19. Questioning the possible role of gas vapors in the West Virginia fire broadens the debate over how to ensure public safety at a time when drastically larger volumes of crude oil are being shipped by rail and roll through cities and towns.
