The latest developments in procedural requirements
The Energy Bar Association (EBA) has finalized speakers for the EBA Annual Meeting and Conference on May 5-6, 2015. The session entitled, Don’t Lose Your Day In "Court": Procedural Compliance will be presented on Wednesday, May 6.
Several recent cases have highlighted the importance in complying with the Federal Energy Regulatory Commission (FERC) and court procedural rules. For instance, the DC Circuit recently dismissed a petition for review challenging FERC’s 30-year license to a hydropower facility where the petitioner sought a second rehearing before seeking appeal. Call for Nominations: American Bar Association
The American Bar Association’s Section of Environment, Energy, and Resources (SEER) annually recognizes outstanding individual and group achievements addressing environmental, energy, and resource matters. Nominations can recommend an individual, a group, or a program or activity. Nominations must be received on or before May 8, 2015.The award will be presented at the ABA Annual Meeting in Chicago.

Cost-pooling agreement decision upheld
On April 2, 2015, a unanimous panel of the United States Court of Appeals for the Second Circuit ("Court") affirmed, in all respects, orders of the Federal Energy Regulatory Commission ("FERC") approving the New York Independent System Operator’s proposal to create a new capacity zone, the Lower Hudson Valley Zone, and establish a demand curve for that zone. First, the Court rejected several jurisdictional claims raised by parties in the action. Going to the merits of the case, the Court found that FERC appropriately (1) relied on generic factual predictions and (2) rejected a phase-in of the implementation of the zone and demand curve, adequately explained why it did not rely on certain evidence, and properly handled certain arguments in a separate proceeding.

FERC approves rules to improve gas-electricity coordination
The U.S. Federal Energy Regulatory Commission on April 16 approved rules to improve coordination of wholesale natural gas and electricity market scheduling as gas is increasingly used for electric generation. After more than three years of evaluation, FERC said in a release its final rule will help ensure the reliable and efficient operation of both the interstate gas pipeline and electricity systems.
Oil industry at turning point in new low-price world
U.S. oil companies have quickly become the new swing factor on the world energy stage, and their ability to handle price volatility could be key in determining future oil prices. "This is a market that's far from settled down, and it's a market that's going to be a lot more volatile," said Daniel Yergin, vice chairman of IHS. "What kind of prices do you need to keep it going?" Yergin said. "What does it mean when you say the U.S. is the new swing producer? It's much easier to swing down than swing up."
Critics: Michigan utility aims to 'monopolize' community solar

Michigan’s first proposed large-scale community solar program is coming under fire from clean-energy advocates who say it would prevent independent third parties from developing their own programs. Within the next month, the Michigan Public Service Commission is expected to rule on Consumers Energy’s proposed 10 MW community solar pilot program, which would be the first program of its kind from one of the two major investor-owned utilities here. Smaller-scale projects are underway or in development elsewhere in the state.
