Commission Denies Pepco/Exelon Merger Application
On Aug. 25, the Public Service Commission of the District of Columbia ("Commission") voted to deny an application for
acquisition of Pepco Holdings, Inc. (PHI) by Exelon Corporation
as not being in the public
In determining whether
the Proposed Merger is in the public interest pursuant to
D.C. Code §§ 34-504 and 34-1001, the Commission first considered the effect of the Proposed Merger transaction on each of the seven public interest factors. This included the effects of the transaction on ratepayers and shareholders, on competition in the local retail and wholesale markets and on conservation of natural resources and preservation of environmental quality.
Texas Natural Gas Foundation forms amid proposed regulation changes

A coalition of industry leaders, politicians and academic leaders have formed the Texas Natural Gas Foundation amid proposed changes to regulations overseeing the multibillion-dollar sector.
Touted as a new source to help educate the public and track natural gas energy trends in Texas and the nation, the group is led by Texas State Rep. Jason Isaac, R-Dripping Springs, and Ken Morgan, director of the Texas Christian University's Energy Institute.
Why can't utilities innovate like startups?
It seems obvious to say that utilities are not known for their innovation. But a new white paper produced by investor-owned utilities and private sector stakeholders suggests that may be because regulators are holding the industry back. The working group that produced the paper could easily have been adversarial but there was a surprising amount of accord, the executive who helped lead the process told Utility Dive.
Alaska: The next energy frontier?
Alaska is getting a lot of attention in the energy industry, partially because U.S. Senator Lisa Murkowski, from Alaska, is now the Chairman of the U.S. Senate Committee on Energy and Natural Resources. But the remote communities of the state offer an opportunity to look into providing power in all types of locations.
Judge upholds denial of rate increase to recover utility revenues lost to efficiency
A Montana district court judge has ruled to uphold an order from the state Public Service Commission (PSC) to deny NorthWestern Energy a proposed rate increase to recover lost revenues, The Associated Press reports. Northwestern sought the rate increase to recover the costs of unexpected outages and lost revenues due to energy efficiency programs. The judge found the PSC rejected the rate hike "based on substantive evidence and by doing so ensured reasonable and just rates," according to the AP.
Annual Gas and Power Institute Co-Sponsored Program

Non-EBA Event: 2015 Midwest Energy Policy Conference
Join the EBA and Missouri Energy Initiative in St. Louis on October 6th and 7th for the Midwest Energy Policy Conference. Energy researchers and policy experts will discuss relevant current issues specific to the Midwest, including the Clean Power Plan, Regional Transmission Organizations (RTOs) Seams, energy storage, and biomass. The event will be held on the campus of Washington University. EBA members receive a 20% discount on registration.
EBA Western Chapter 2nd Annual Canadian Forum

The Electricity Regulation Committee of the Energy Bar Association presents this one-hour luncheon on the basics of developing and administering filings under Sections 205 and 206 of the Federal Power Act. Lunch will be held from 12:30 to 1:30 on Wednesday, October 28th at the offices of Greenberg Traurig on L Street in Washington, DC. Panelists will discuss the roles of law practitioners in developing and administering filings and present practical considerations and tips.
