As more foreign citizens become subject to U.S. taxation, practitioners must be comfortable with the various issues that can arise, including determining residency for federal tax purposes, dual-status taxpayers, tax treatment of income and expenses for nonresident aliens, available elections and tax credits, administrative issues, and departure filing requirements.

The U.S. Bureau of Labor Statistics reported today that the consumer price index (CPI) has increased by 0.1% for August, after rising 0.3% in July. Here’s what that means for taxpayers in 2020, together with a first look at predicted rates for the next year as calculated by Bloomberg Tax & Accounting. The CPI measures the cost of goods and services—in other words, your cost of living. Under the Tax Cuts And Jobs Act (TCJA), the Internal Revenue Service (IRS) now figures cost-of-living adjustments using a “chained” CPI.

When taxpayers use online systems, the IRS really wants to make sure the people accessing information are who they say they are. The agency has implemented a number of authentication tools over the years — with varying degrees of success — and is now looking at behavioral analytics as an option. The IRS announced a sole-source contract to BioCatch for a proof-of-concept that would incorporate behavioral analytics for the agency’s eAuthentication system. BioCatch’s technology tracks how a user interacts with their device and the agency’s apps to continually verify their identity.

The IRS recently released new estimates of the "tax gap" — the difference between the amount of taxes owed and the amount that’s paid on time — which lawmakers had been awaiting as they consider funding for the agency and ways to boost tax compliance. The estimates show that the average annual gross tax gap was $441 billion for the tax years from 2011 to 2013. The agency estimated that $352 billion of the tax gap was due to underreporting, $50 billion was due to underpayment and $39 billion was due to nonfiling.

The Internal Revenue Service released drafts of the two critical partnership forms for 2019. The proposed versions of Form 1065, “U.S. Return of Partnership Income,” and Schedule K-1, “Partner’s Share of Income Deductions, Credits, etc.,” have been updated in hopes of improving the quality of information that partnerships report to both the IRS and their partners.

The Internal Revenue Service (IRS) released a new report and infographic recently illustrating unpaid or underpaid taxes for the years 2011 – 2013. The numbers reflect estimates based on the last such findings, for the years 2008 – 2010. With commissioner Chuck Rettig citing the importance of voluntary compliance, and crypto’s popularity on the rise, the IRS is growing increasingly concerned with opportunities for tax evasion afforded by the new digital money.

A Montana nonprofit led by a federal land critic should give up its tax-exempt status because of lobbying activities, according to two watchdog groups. Recently, the Washington, D.C.-based Campaign for Accountability sent a complaint to the Internal Revenue Service claiming Citizens for Balanced Use has repeatedly violated laws that limit the amount of lobbying that tax-exempt nonprofit organizations are allowed to carry out.

The IRS is projecting that it will see 12.4% more information and withholding documents in 2020 than it projected last year, driven largely by an increase in Forms 1099-B. The projections were released today in Publication 6292, “Fiscal Year Return Projections for the United States, Fall 2019 Edition.” This semiannual publication contains projections for Fiscal 2019 through 2026 of some 50 individual, business and tax-exempt return types, such as 1040, 1120, 941 and 990, to be filed by the major return categories.

Congress didn’t unconstitutionally penalize Democratic-leaning states when it imposed a cap on federal deductions for state and local taxes, a federal judge recently ruled. The 2017 federal tax law, which President Trump signed after a party-line vote in Congress, limited to $10,000 the state and local tax payments that families can write off on their federal income taxes if they itemize deductions.
