National Law Review
Recently, the U.S. Court of Appeals for the District of Columbia Circuit rejected all of American industry’s many challenges to the Occupational Safety and Health Administration’s (OSHA) new silica dust standard, 29 C.F.R. §§ 1910.1053 and 1926.1153 — one of the key achievements of OSHA under the Obama administration. The court remanded the standard for OSHA to further explain or reconsider why it did not adopt medical removal protection.

The leading case on this issue comes out of New York. A surveyor prepared a site plan for the construction of a new building. The plan consisted of a depiction of the grade, land contours, and a proposed location for the building and utilities. During construction, the original surveyor was terminated and an amended survey plan was used. The new plan was substantially similar to the original, prompting the first surveyor to file a copyright infringement suit.
The district court found that the site plan was not copyrightable and noted that the identification of existing physical characteristics of the site, such as elevation measurements and location of boundaries, are not afforded copyright protection.

Recently I was talking with a group of remodelers about the labor shortage, and one of the people in the discussion made an especially insightful comment. The observation came from Vince Nardo, president of Reborn Cabinets, in Southern California. “In order to be more successful at hiring, I had to change the mindset of our HR department,” Vince said. “They were looking at recruitment from the perspective of a human resources task, but it’s not that anymore; it’s a sales and marketing task.”
The concept made total sense, and my first impulse was to take it at face value. I began thinking about ways to market your company as a great place to work, including writing strategic posts on social media, creating catchy classified ads, and making sure every company benefit was discussed in each job interview.

Keep it simple but address the details. And try this short-cut.
Several weeks ago a piece I wrote titled How to Write a Problem-Solving, Career-Protecting Remodeling Job Proposal was posted. A reader sent me the following:
I just read your article about writing a problem-solving, career-protecting remodel job proposal. You hit the nail on the head perfectly.
I manage the estimating and proposal writing for a large portion of my company. From time to time we get small jobs and they do not need the 20-pound proposal dropped on their desk. We have cut it down on some jobs but I would be curious of the type of template you have used on a remodeling jobs and what it looks like. Would you share a template with me?
Reader, I’m glad you enjoyed the article. I don’t have a template, but here are some things to keep in mind when preparing a small job “proposal.”

Succession planning and passing the “bus test” ought to be a priority for every remodeling company owner.
While packing up my tools at the end of one late-winter workday in 1987, I slipped on a patch of ice. I didn’t fall, but it may have been better if I had. Instead, I caught my balance and wrenched my back, aggravating an old lower-back injury. I didn’t realize how bad it was until I arrived home an hour later after a 45-minute drive and couldn’t get out of the van.
I spent the next 10 days lying flat on my back on the living room rug. At first I focused mainly on finding a comfortable position and on mastering the precise choreography needed to avoid excruciating pain while getting up off the floor to eat or to answer a call of nature. But it was a long 10 days, so I had plenty of time to think about how much my remodeling company depended on my personal involvement in each project, and about the risk that represented, not just for me but for everyone who worked for or with me. At the time, we were punching out a custom home, a phase of construction that my employees typically handled with minimal involvement (they might say “minimal interference”) from me. But it would have been a different story had I been out of commission during preconstruction and startup—a time when I was often the go-to guy.
