New PPP Forgiveness Guidance Addresses Owner-Employee Compensation, Rent-Related Costs

The U.S. Small Business Administration (SBA) and Treasury issued an interim final rule Monday addressing Paycheck Protection Program (PPP) forgiveness issues related to owner-employee compensation and the eligibility of nonpayroll costs. Specifically, the interim final rule establishes that owner-employees with less than a 5% stake in a C or S corporation are exempted from the PPP owner-employee compensation rule for determining the amount of their compensation for loan forgiveness.

Chris graduated from Vassar College, and earned his M.A. in architecture from Columbia Architecture School. Chris is a member of the American Institute of Architects, and has 28 years of experience in residential architecture. He is a current member of the DC Historic Preservation Review Board and past president of the DC Metro area chapter of NARI.

Remodeling and Residential Construction Deemed 'Essential'

Shelter-in-place orders in three U.S. States: California, New York and Illinois have deemed residential construction as an “essential” activity and therefore remodeling and home improvement contractors may continue to operate. Pennsylvania’s order is more restrictive allowing construction activity on an emergency basis. Significantly, building material wholesalers and retailers are also deemed essential in those states.
