Question:
We have been hired to prepare ALTA Surveys on a number of properties across our state for a solar farm company. This company is looking at leasing the land that they will use for a solar field. In some cases they will be leasing the entire property. In other cases they will only be leasing a portion of the property. Can we limit our survey to only include the lease area if the legal description in the title commitment is for the entire property? Or do we need to create a new legal for the lease area and have the title commitment reference this new legal?
Response:
There is nothing wrong at all with what you propose; you can do a land title survey of only a portion of the property. It is likely that the first title commitment will reflect the entire property because they have no description for the lease areas. I suspect once they have descriptions (which you would presumably write), they will issue revised commitments covering only the leases.
However, I would talk with the title company and the client’s attorney about how to approach this so there are no surprises, and you can avoid potential rework. In the end, it is up to them as to what property will be described in Schedule A and therefore insured, not the surveyor.

Through the years, the program has been upgraded, including a continuing education element. Donald Buhler, Branch Chief, BLM Cadastral Survey and Lands, and Ron Scherler, formerly with BLM and currently serving as CFedS Training support, will join host Curt Sumner to discuss the current status of the program, as well as its projected future.

The Obama administration is proposing to spend nearly $4 billion over the coming years to accelerate the acceptance of driverless cars on U.S. roads and curb traffic fatalities and travel delays. The proposal, which would require congressional approval, aims to have federal regulators work with auto makers and others to craft policies and rules for vehicles that can move without a driver at the wheel. Self-navigating vehicles will require highly accurate road data derived for surveying and mapping.

The Obama administration announced last Friday it will halt new coal leases on federal lands — a blow to the coal industry and reduction in the demand for public land surveys. Companies will continue to be able to mine coal reserves already under lease. Roughly 40 percent of the coal produced in the United States comes from federal lands, the vast majority from Wyoming, Montana, Colorado, Utah and New Mexico.

The Small Business Committee of the U.S. House of Representatives last week approved bipartisan legislation to expand and improve opportunities for America’s small firms to compete for federal contracts. The measure, H.R. 4341, the Defending America’s Small Contractors Act of 2016, was approved unanimously by the panel and now advances to the full House of Representatives for consideration. The bill modernizes the Small Business Act, and the SBA’s reporting requirements, to ensure that the language used is clear and consistent across federal procurement programs; strengthens the small business advocates within SBA and other federal agencies so they can promote competition and compliance; improves opportunities for small businesses to compete for subcontracts, and then to capitalize on that experience to compete as prime contractors, thereby strengthening the industrial base; improves coordination and data sharing between the SBA’s government-wide mentor-protégé program, civilian agency mentor-protégé programs, and the mentor-protégé program at the Department of Defense; and implements reforms to ensuring integrity in small business programs, such as the agricultural size standards, veterans contracting programs, SBA operations and contracting officer training programs.

GPS World
The fifth satellite in the Indian Regional Navigation Satellite System constellation lifted off on time Jan. 20 from Satish Dhawan Space Center on Sriharikota Island, on India's east coast.
As in the previous four launches of IRNSS satellites, the navigation satellite rode aboard a Polar Satellite Launch Vehicle. This is the 33rd launch for the PSLV.
