NSPS Government Affairs Chairman Pat Smith met last week in the Washington, DC area with Executive Director Curt Sumner, NSPS Government Affairs Consultant John Palatiello, and NSPS Lobbyist John "JB" Byrd to plan legislative priorities for the 2019-2020 session (116th) of Congress and administrative policy in Federal agencies. Among the issues discusses were workforce development, subsidence, licensing, NSRS 2022, infrastructure, procurement, Digital Coast, 3DEP, FEMA flood mapping, and others. A 2019 Winter Report on current activities and issues, as well as highlights of NSPS accomplishments in 2018 is now available.

Two weeks ago, NSPS President-Elect Lisa Van Horn received a telephone call concerning a ruling in a Court Case in Louisiana which had some extremely detrimental potential outcomes for the PLSS system in the United States. President Leavitt, Vice President-Elect Tim Burch, and John Matonich (a NSPS Past President) were also contacted directly, and they agreed that the ExCom should know more. The individual who brought the case to the attention of NSPS flew into Wisconsin at his own expense to do so. His request was that NSPS submit an Amicus Brief.
In the past couple of days NSPS has been informed that its Amicus Brief has been accepted by the Court.
An Amicus Brief is defined as: "Frequently, a person or group who is not a party to an action, but has a strong interest in the matter, will petition the court for permission to submit a brief in the action with the intent of influencing the court's decision. Such briefs are called "amicus briefs."
This announcement is provided to alert readers of NSPS News & Views of this matter, and is not intended to provide details at this point. As the details evolve they will be provided in a follow up article about this issue.

The Coalition of Geospatial Organizations (COGO) has released a second Report Card on progress implementing a National Spatial Data Infrastructure (NSDI). This Report Card serves as a periodic assessment of the condition of the nation’s geospatial data infrastructure, which, like other forms of public works, is essential for our economy, health, safety, and activities of daily life. The new report includes more than 100 pages of evaluation from matter experts in the public and private sectors with knowledge in each of the eight national framework data themes: addresses, cadastres, elevation, geodetic controls, governmental units, hydrography, orthoimagery, and transportation. Each team assessed the developments and advances within their respective themes since the 2015 Report Card and engaged with the Federal Geographic Data Committee for guidance and feedback as they determined new individual scores. The full NSDI also received a grade of B-, reflecting some improvements over its 2015 grade of C. COGO’s first NSDI Report Card was a wake-up call for Congress to take action in this important area, and contributed in part to enactment of the Geospatial Data Act, Public Law 115-254 in 2018.

The Congressional Research Services (CRS) has published recent reports on volcanoes, landslides and earthquakes. Federal legislation, if enacted, would authorize USGS to modernize the monitoring system using digital broadband seismometers, real-time Global Positioning System (GPS) receivers, satellite and airborne radar interferometry, acoustic pressure sensors, and spectrometry to measure gas emissions from volcanoes. Both S. 698 and H.R. 1675, landslide legislation in the 115th Congress (2017-2018) would authorize the 3D elevation program (3DEP) in U.S. Geological Survey to enable the use of cooperative agreements and promote the development and maintenance of spatial data infrastructure. Earthquake legislation has a requirement for "publishing a systematic set of maps of active faults and folds, liquefaction susceptibility, susceptibility for earthquake induced landslides, and other seismically induced hazards." If carried out, such a repository of maps could be considered an important tool for reducing earthquake risk by the spectrum of potential users at the federal, state, local, and tribal government level, as well as the developers of national building codes, developers, building owners, and others involved in planning and construction of the structural environment.

President Trump is has nominated David Bernhardt to be the Interior Department’s next secretary. Bernhardt will lead an agency that oversees about 500 million acres of Federal land, and agencies such as the Bureau of Land Management, U.S. Geological Survey, and the Federal Geographic Data Committee (FGDC). The department has 70,000 employees in various agencies overseeing federal land, offshore drilling, endangered species and American Indian affairs, among other duties. He became the agency’s deputy secretary in 2017 and has led the department on an interim basis since former Secretary Ryan Zinke resigned in January. As deputy secretary, Bernhardt’s nomination will go to the Senate Energy and Natural Resources Committee for a confirmation hearing, followed by committee and full Senate votes.
