Question:
I have an attorney working for the purchaser, and he is asking me to include his firm's name to the surveyor's certification.
He is from Florida and claims they do this all the time there.
I have been surveying for 31 years, and have asked several friends if they ever had a request like this. None have.
As a side note, my contract is with the attorney for the seller. My client does not care what I do as long as it does not delay the settlement.
Response:
This request is becoming more common around the country; we do it frequently.
However, we write into our contract that we will certify to the lender, buyer and title company only, but that additional parties may be certified to for an additional fee. Frankly, depending on the client and how pleasant (or not) the attorney has been to work with, we may waive the additional fee (which we would otherwise charge in order to account for the additional liability).

Land surveyors often have occasion to address title issues along with boundary issues, making education pertaining to other forms of title, aside from fee ownership of land, relevant to surveyors, particularly those who perform ALTA surveys and wish to provide their clients with a complete and highly informative product. The proper identification and categorization of land rights has become a matter of high importance to our society, and effective documentation of land rights is vital to that task, but verification of federal land rights can be highly problematic, often requiring judicial resolution. This article represents the next in a series on issues that arise in the federal context, written by federal land rights expert and historian of land rights law Brian Portwood, emphasizing the importance of understanding many aspects of federal land rights, and in this instance federal jurisdiction as well, from the perspective of a professional land surveyor. This series is being produced and published for the educational benefit of all those who are employed as professionals in the many branches of the title and land acquisition industry.

One of the top NSPS legislative priorities took a major step toward reality last week when the U.S. Senate approved the Energy Policy Modernization Act of 2016, S. 2012. Included in the bill is a modified version of the Federal Land Asset Inventory Reform (FLAIR) Act S. 1225 and the collection of energy-related "data gathered by geomatics techniques, including tools and techniques used in land surveying, remote sensing, cartography, geographic information systems, global navigation satellite systems, photogrammetry, geophysics, geography, or other remote means." The energy bill must now be considered in the U.S. House of Representatives.

The Commerce, Science and Transportation Committee of the U.S. Senate is scheduled to consider today S. 2325, the Digital Coast Act. This bill, to authorize a program of geospatial data acquisition and application to the coastal areas of the United States in the National Oceanic and Atmospheric Administration (NOAA), is another top NSPS legislative priority and was an issue NSPS and MAPPS members took to Congress in March.

Monday, May 2, through Friday, May 6, is Construction Safety Week, a time to increase awareness of the importance of being committed to safety on job sites and to conduct on-site safety awareness activities. Surveying firms should use this special week to review safety procedures for crews and remind all workers of the importance of safety in the field.

NSPS government relations consultant John Palatiello served this week as a judge for the project competition hosted by the Construction Industry Roundtable (CIRT) and the ACE Mentor Program of America. ACE President and CEO Jack Kalavritinos was the keynote speaker at the MAPPS-NSPS joint conference in March, and a recent guest on the NSPS Radio Hour. NSPS is exploring ways in which to assist surveyors across the country in learning how to become much needed mentors to high school students in learning about surveying principles as they apply to their ACE projects.
The Design Competition features projects developed by high school students working with mentors from architecture, construction and engineering (ACE). Projects included use and application of elevation, topographic, boundary, GIS and other spatial data. "The students in the ACE Mentor Program represent the future workforce in architecture, construction and engineering who are gaining an appreciation of and introduction to surveying, mapping and geospatial data and applications. I was impressed by the knowledge, poise and potential of these students," Palatiello said.

NSPS lobbyist John "JB" Byrd attended a recent workshop of the Mapping Science Committee of the National Research Council in Washington, D.C. The session focused on federal efforts to create a national address database. Presentations were made by representatives of the Census Bureau, Department of Transportation (USDOT), National Science Foundation (NSF) and the National Institute for Science and Technology (NIST). The discussion also covered the announcement last month for the Smart Cities Challenge. In March, the USDOT pledged up to $40 million to one city, to be awarded in June 2016, to help it define what it means to be a "Smart City" and become the country's first city to fully integrate innovative technologies — self-driving cars, connected vehicles, and smart sensors — into their transportation network. USDOT Secretary Anthony Foxx announced the finalists to be: Austin, TX; Columbus, OH; Denver, CO; Kansas City, MO; Pittsburgh, PA; Portland, OR; and San Francisco, CA. USDOT developed the Smart City Challenge as a response to the trends identified in the 2015 "Beyond Traffic" draft report. The report revealed that our nation's aging infrastructure is not equipped to deal with a dramatically growing population in regions throughout the country. It also identified a need to increase mobility options in developing megaregions — specifically mid-sized cities.

Prior to the 1860 annexation of the Savoy region, where Mont Blanc lies, Barre des Écrins — at 13,458 feet — was the highest peak in France. The mountain is located in the French region of Provence-Alpes-Cote d'Azur and was climbed for the first time by a group of British climbers in 1864.
