Question:
I have an unusual situation (for me anyways) on a project for an ALTA/NSPS Land Title Survey on a Condominium property. The situation is that only buildings 1 and 2 have been constructed, but buildings 3-6 along with their units are in the legal description and shown on the Plat. The title commitment shows they were insuring all units — even the ones in buildings not built yet. I've shown the non-constructed building's relative position taken from the Condo Plat on my survey. I put a note on the survey that at the time of the survey only buildings 1 and 2 had been constructed. The Title company will not insure Title if proposed buildings are shown on the survey, and they want me to remove them, to which I have said no. I feel even though they are not constructed, they are a matter of record and should be shown. The title commitment shows they were insuring all units — even the ones in buildings not built yet.
Response:
Considering that they appear to be insuring all of the units, it seems that it would be appropriate to show the other buildings, as long as you indicate that they are unfinished (or perhaps not even under construction!)
Resolution: The title company decided the Surveyor could leave the proposed buildings on the plat, and the title company simply added a new schedule B2 item that said they were not insuring that the proposed buildings would not encroach, etc., etc.
Editor's Note: That seems to be entirely appropriate, although it still isn't clear whether the title company understands that they are insuring units that don't exist!

NSPS
NSPS members and readers of NSPS News and Views will recall that several years ago a company called LightSquared was a topic of discussion among those (including Surveyors) who use GPS. The proposed activities from that time were never allowed to move forward. Recently, the successor (Ligado) to LightSquared has been the topic of some media attention. It is difficult to determine if this new proposal would have a similar effect on GPS users (such as Surveyors) as was determined to be the case with the prior intended use, but we thought the issue is worth bringing to the attention of our readers. We will keep you informed as more is learned.

NSPS Government Affairs Consultant John Palatiello chats with Rep. Tom McClintock (R-CA), chair of the Subcommittee on Federal Lands, at the conclusion of the May 23rd FLAIR Act hearing
H.R. 2199, the "Federal Land Asset Inventory Reform (FLAIR) Act", long supported by NSPS, was the subject of a legislative hearing (with an archived video) yesterday before the Subcommittee on Federal Lands of the Committee on Natural Resources in the U.S. House of Representatives. NSPS Government Affairs Consultant John Palatiello testified on behalf of MAPPS and submitted a NSPS statement for the record. Also testifying was Rep. Kevin Cramer (R-ND), the bill's sponsor. A committee memo prepared by Congressional staff in preparation for the hearing outlined the need for the bill to create a current, accurate federal inventory or cadastre of all federal land.

A proposal to create a massive, earth observation contract on the General Services Administration (GSA) schedule, known as CIBORG would violate the federal Brooks Act and numerous state licensing laws for surveying, NSPS said in a letter to GSA. The procurement vehicle fails to recognize that numerous services proposed to be acquired through the contract are defined as architectural, engineering and related services under federal law, regulations and Comptroller general decisions, NSPS claimed. GSA, working with the National Geospatial Intelligence Agency (NGA), seeks to create a price list schedule for services it has classified as information technology (IT), which can be used by all federal agencies, as well as state and local government. NSPS has sked that the procurement proposal be withdrawn.

The U.S. Court of Appeals for the D.C. Circuit vacated the Federal Aviation Administration's registration rule for recreational unmanned aerial system operators on the grounds that it violates a provision of the FAA Modernization and Reform Act of 2012 that prohibits the FAA from promulgating "any rules or regulation regarding a model aircraft."

Before the FAA's Rule 107 allowing UAS use for commercial work, we waited patiently (and often impatiently) for the day when UAS would be "unleashed."
