Question:
It seems that I'm at odds with some on whether in performing either a boundary survey or an ALTA/NSPS survey one should find as many property corners or monuments as possible on the block in which the parcel is situated. Some say just locate the property corners of the site for an ALTA/NSPS survey, while if you are doing a boundary then you go outside your site. I believe you should do this for both in order to prove that the parcel is where it is supposed to be. Am I wrong in thinking this way? Is an ALTA/NSPS survey more like a supersized mortgage survey where you just find the property corners of that parcel or site, and then any additional items on Schedule A? I'm curious now.

Those who say that an ALTA/NSPS Land Title Survey is something less than a boundary survey are woefully misinformed and have apparently not read the Standards. A Land Title Survey is not just a supersized mortgage survey. Here is what Section 3.D. of the 2016 (and 2011) Standards say about this issue. "The boundary lines and corners of any property being surveyed as part of an ALTA/NSPS Land Title Survey shall be established and/or retraced in accordance with appropriate boundary law principles governed by the set of facts and evidence found in the course of performing the research and fieldwork." Clearly an ALTA/NSPS Land Title Survey is a boundary survey. It's a boundary survey to a higher set of standards than a "generic" boundary survey. Someone approaching a Land Title Survey as something less than a boundary survey would likely suffer a claim of malpractice or negligence if something goes wrong.

Following up on a motion passed by the NSPS Board of Directors during its March 2016 meeting, NSPS President Tony Cavell recently sent a letter to the National Association of Realtors (NAR) urging the organization to add the following language to Article 13 of its Code of Ethics and Standards of Practice document: "REALTORS® shall not engage in activities that constitute the unauthorized practice of Land Surveying and shall recommend that counsel of a professional land surveyor be obtained when the interest of any party to the transaction requires it."
This language closely resembles current language in NAR's ethics document related to legal practice. NAR has responded to NSPS requesting an audience to discuss the matter in order to gain "a better understanding of the conduct you are hoping the Code of Ethics would be amended to address." NSPS has been compiling information for that meeting. Anyone who has confirmable evidence of such behavior by Realtors should contact NSPS Executive Curt Sumner, curtis.sumner@nsps.us.com.

The 2016 FIG Working Week was held May 2-6 in Christchurch, New Zealand with the theme of Recovery from Disaster based on recovery efforts from the damaging earthquake and aftershocks Christchurch experienced in September 2010 and February 2011. The 3rd FIG Young Surveyors Conference was held prior to the working week on April 30-May 1.
Over 800 attendees from 62 countries participated with over 400 papers being presented during the working week.
NSPS members attending the working week included Robert Foster (ACSM Past President and FIG Honorary President), Amanda Askren (NSPS Young Surveyors), Marcus Beagley, John Hamilton, Steve Nystrom (Chair, FIG Commission 9), Gus Porter, Dan Roman (NGS), Jon Warren (NSPS Immediate Past President), John Hohol (NSPS Head of Delegation, President- FIG Foundation and FIG Honorary Member).
Some items directly related to NSPS included the establishment of a Council of Regional Bodies (CRB) composed of regional bodies like CLGE (Council of European Geodetic Surveyors), APPA (Pan American Association of Professional Land Surveying), NSPS, RICS (Royal Institution of Chartered Surveyors), UAG (Arab Union of Surveyors), UMG (Mediterranean Union of Surveyors). In addition, the CRB will take the lead in helping to organize and establish a Global Surveyors’ Day.
Two new FIG Vice Presidents were elected to serve the term 2017-2020: Orhan Ercan (Turkey) and Mikael Lilje (Sweden). They replace outgoing Vice Presidents Pengfei Cheng (China) and Bruno Razza (Italy). The new FIG Council for the term 2017-2018 is FIG President Chryssy Potsiou (Greece), Diane Dumashie (United Kingdom), Orhan Ercan (Turkey), Mikael Lilje (Sweden), Rudolf Staiger (Germany).
In the voting for the selection of the venue for the 2020 FIG Working Week Amsterdam, The Netherlands was chosen over Innsbruck, Switzerland. Other venues already selected include the 2017 FIG Working Week in Helsinki, Finland and the 2018 XXVI FIG Congress in Istanbul, Turkey.

The U.S. House of Representatives earlier this week passed H.R. 4465, the "Federal Assets Sale and Transfer Act of 2016." Sponsored by Rep. Jeff Denham (R-CA), the bill seeks to improve the process of surplus and disposal of unneeded Federal land and buildings. Section 21 of the bill improves the GSA database, known as the Federal Real Property Profile (FRPP), for all real property owned by the Federal government. It authorizes GSA to "publish a single, comprehensive, and descriptive database of all Federal real property under the custody and control of all executive agencies, other than Federal real property excluded for reasons of national security." The database will include the geographic location of each Federal real property of each such agency, including the address and description for each such property, and the level of use of each Federal real property for each such agency, including whether such property is excess, surplus, underutilized, or unutilized. The GSA database will be accessible by Federal agency personnel, as well as to the public at no cost, through GSA's Web site. The database will provide a level of transparency far greater than what is currently available, using an open, machine-readable format; will permit users to search and sort Federal real property data; and include a way to download a large amount of Federal real property data and a selection of such data retrieved using a search. The Senate version of this bill (S. 2375) is awaiting action on the Senate floor.

NSPS lobbyist John "JB" Byrd recently met with Brian Kelsey (R) who is running for the 8th Congressional District in Tennessee, an open seat currently held by retiring Congressman Stephen Fincher (R). Kelsey is a small business owner and lawyer, and currently is a State Senator with a 100% rating by NFIB. In the state senate, Brian sponsored and passed a constitutional amendment to forever ban a state income tax. In the rural 8th District, agribusiness is the major employer. Tennessee's state primary will be held on Aug. 4.

As reported in last week's News & Views, two amendments of interest to surveyors were proposed to be offered in the U.S. House of Representatives to the 2017 National Defense Authorization Act (NDAA). Both amendments were added to the bill. Rep. Paul Gosar (R-AZ) added a provision that requires a Congressional briefing on implementation of and adherence to a 2015 memo concerning DoD's development and maintenance of a current, accurate, interoperable cadastral geographic information systems-based inventory of Department of Defense buildings, land, and other real property assets. Also, a pro-GPS amendment was added to the same bill by Reps. Mike Rogers (R-AL) and Jim Cooper (D-TN). That provision prevents any proposal like the past "LightSquared" system from interfering with GPS signals. The previous proposal to permit commercial terrestrial operations in frequency bands adjacent to those on which GPS operates, if permitted by the Federal Communications Commission, would have created widespread harmful interference with GPS. The FCC is now considering, and has recently released, a public notice concerning a new proposal, which currently has no known adverse impacts to the DoD. The U.S. Senate this week begins work on its version of the 2017 NDAA.

The webcast of a markup session held last week by the House Oversight and Government Reform Committee, in which approved H.R. 5199, the "Construction Consensus Procurement Improvement Act of 2016" is now available. News and Views reported last week that the bill, introduced by Rep. Mark Meadows (R-NC), would limit the use of one-step design-build and reverse auctions in federal procurement of design and construction services. Section 4 specifically prohibits federal agency use of reverse auctions for architectural and engineering services, including surveying and mapping, which have been typically connected to qualifications-based-selection under the Brooks Act. This protection for QBS has long been championed by NSPS and COFPAES, of which NSPS is a member, and NSPS joined other groups recently in a letter supporting H.R. 5199. Similar legislation (S. 1526) has already moved out of a committee of the U.S. Senate and is awaiting floor action. Rep. Meadows was a speaker at the NSPS-MAPPS joint PAC breakfast held during the National Surveying, Mapping and Geospatial Conference in March of this year.

The Galileo satellite navigation system that will help Europe find its way in the 21st century now has 14 satellites in orbit after this week's double launch.
Galileos 13 and 14 lifted off together atop a Soyuz rocket from French Guiana.
