NSPS has filed an objection to a procurement solicitation by the Virginia Department of General Services (DGS) that would include services that fall within most state law definitions of the practice of surveying, but fails to require a licensed surveyor in responsible charge.
A Request for Proposal for Unmanned Aerial System Services issued by DGS on behalf of the ValuePoint Cooperative Purchasing Organization, LLC, a nonprofit subsidiary of National Association of State Purchasing Officials (NASPO). It asks for bids, including price, for a variety of services to be performed with an unmanned aircraft system (UAS or "drone"), including several surveying and mapping tasks, in Virginia and several other states, with an option for any state to participate. NSPS has joined with state surveying societies in Virginia and Maryland noting the solicitation does not include a requirement for a licensed professional surveyor, in violation of the law in many other states, as the services sought fall within most licensing law definitions of the practice of land surveying, and, as a professional service. NSPS also pointed out the RFP does not comply with the Virginia qualifications based selection (QBS) law, or similar "mini-Brooks Acts" in numerous other states. The NASPO Cooperative facilitates administration of the cooperative group contracting consortium for the benefit of state departments, institutions, agencies, political subdivisions, and other eligible entities.

A delegation from NSPS will meet next week with Rep. Rick Crawford (R-AR) to discuss the society’s concerns for provisions in H.R. 5559, the "Scientific Flood Mapping Act of 2018" . The bill, introduced by Rep. Crawford on April 18, would remove private sector members from the Technical Mapping Advisory Council (TMAC), which advises the Federal Emergency Management Agency (FEMA) on surveying and mapping issues related to the National Flood Insurance Program (NFIP). The June 7 meeting on Capitol Hill in Washington, DC will seek ways to improve the TMAC and NFIP, without eliminating the valuable input FEMA gets from professionals in the private sector from surveying, mapping, engineering and other technical and professional disciplines.

NSPS Government Affairs Consultant John Palatiello advocated for surveying and geospatial data collection programs to support sustainable development of smart cities across the United States at a May 29 briefing in the U.S. Capitol. Palatiello was a panelist in a discussion hosted by the Congressional Smart Cities Caucus. In his remarks, Palatiello noted that surveyors are often lead professionals in the development of geographic information systems that integrate data for planning and integration of land use, transportation, housing and government services. He pointed to the National Spatial Data Infrastructure; H.R. 4905, the "Improvement of Mapping, Addresses, Geography, Elevations, and Structures (IMAGES) Act of 2018" introduced by Rep. Alex Mooney (R-WV) and Rep. Vicente Gonzalez (D-TX); H.R. 2199, the "Federal Land Asset Inventory Reform (FLAIR) Act" introduced by Rep. Kevin Cramer (R-ND) and Rep. Ron Kind (D-WI); H.R. 4062, the "Digital Coast Act" introduced by Rep. C.A. "Dutch" Ruppersberger (D-MD) and Rep. Don Young (R-AK); and appropriations for the USGS 3DEP program as examples of geospatial data programs Congress should support to further sustainable development in smart cities.

At a recent breakfast panel event on infrastructure in Washington, DC, NSPS Federal Lobbyist John "JB" Byrd asked a question on the USGS 3D Elevation Program (3DEP) of Sens. Todd Young (R-IN) and Gary Peters (D-MI). In his answer to JB's question, Sen. Young brought to everyone's attention the importance of professional surveyors with a focus on broadband deployment and "digging."

The House Committee on Transportation last week reported the House version of the Water Resources Development Act (WRDA) favorable out of committee. In addition, the Senate Committee on Environment and Public Works also reported out the Senate version of the bill. The next step will be full House and Senate votes in addition to reconciling the two versions of the bills.

The long-awaited Final Report for the U.S. Department of Transportation's Adjacent Band Compatibility Assessment was released on April 26.
The report is the culmination of several years of test and analysis conducted by the DOT, with input and assistance from the public and federal agency stakeholders. Though not explicitly motivated by it, the assessment appears to be responsive to the Positioning, Navigation, and Timing Executive Committee's Jan. 13, 2012, memorandum to the National Telecommunications and Information Administration.
