E. Donald "Don" Bengel, 80, of Valparaiso passed away Saturday, June 9, 2018. He was born June 1, 1938 in Baltimore, MD. Don was a proud alum of Baltimore Polytechnic Institute and went on to receive a B.S. in Civil Engineering from Valparaiso University in 1961. Don founded Bengel Engineering and Surveying, which he owned and operated for over 50 years. He served as Porter County Surveyor for four terms, from 1980-1996 and was active in many professional organizations. Don served on the Board and was a Past President for both the Northwest Chapter and the state board of the Indiana Society of Professional Land Surveyors (ISPLS). He represented Indiana as a member of the Board of Governors and Board of Directors of the National Society of Professional Surveyors (NSPS) and was Indiana’s delegate on NSPS's Great Lakes Council. Don was a past Chairman of the Northwest Indiana Regional Planning Commission (NIRPC). Don was also active in Republican politics serving for many years as precinct committeeman and was also elected to serve as a state convention delegate. Don's greatest passion second to his family was the Boy Scouts of America. Don was actively involved in scouting since his boyhood. As an adult, his service began with Valparaiso Troop 907 when his three sons were scouts. He took great pride that each of them as well as his oldest grandson achieved the rank of Eagle Scout. He attended several National Scout Jamborees and twice hiked Philmont Scout Ranch. Don served in many capacities in scouting over the years, including camp inspections, Eagle review boards and district leadership. He received the Silver Beaver Award in 2006. On June 26, 1960 Don married his college sweetheart, Betty, and together they had four children: twins Eric (Robin) Bengel of Valparaiso and Lauralyn Bengel of Chicago, Dirk (Patricia) Bengel of Greenville, SC and Mark (Michelle) Bengel of Valparaiso. He was a proud Pop-Pop to six grandchildren: Erica, Kelsey (Justin), Jack, Nicole (Kirk), Shannon and Peter. He is also survived by his two brothers, Richard (Gail) and Elvin (Donna) Hudson and their children: Sean (Trista) and Adrienne (Craig), Adam and Kate Hudson, as well as his niece, Megan (Victor) and nephew Dan (Debbie). Don was preceded in death by his mother, Carolyn Hudson, his grandfather, Leonard Bengel and his beloved uncle, Leonard "Buddy" Bengel.
A visitation will be held Thursday June 14 from 3-6 PM at Moeller Funeral Home, Valparaiso, with a funeral service beginning at 6:00 PM. In lieu of flowers, memorial donations may be made to Boy Scouts of America, LaSalle Council, 1340 South Bend Ave., South Bend, IN 46617 (please specify for camp properties).

The Senate Committee on Agriculture recently released its version of the 2018 Farm Bill, to extend programs for reauthorization beyond September 30, make reforms, and provide new programs. Section 1703 provides that the USDA Secretary shall reduce administrative burdens and costs to producers by streamlining and reducing paperwork, forms, and other administrative requirements, including through the implementation of the Acreage Crop Reporting and Streamlining Initiative that shall ensure that a producer may report information electronically, including the use of geospatial data, to USDA. Section 2408 cites the costs associated with securing a deed to the agricultural land easement, including the cost of appraisal, survey, inspection, and title via the Agricultural Conservation Easement Program. Section 6205 allows for broadband build-out data to include "precise geolocation data" without defining the term. The Senate panel's markup is scheduled for this week.

The North Carolina Society of Surveyors (NCSS) has joined NSPS, the Virginia Association of Surveyors (VAS), and Maryland Society of Surveyors (MSS) objecting to a procurement solicitation by the Virginia Department of General Services (DGS) that would include services that fall within most state law definitions of the practice of surveying, but fails to require a licensed surveyor in responsible charge.
A Request for Proposal for Unmanned Aerial System Services issued by DGS on behalf of the ValuePoint Cooperative Purchasing Organization, LLC, a nonprofit subsidiary of National Association of State Purchasing Officials (NASPO). It asks for bids, including price, for a variety of services to be performed with an unmanned aircraft system (UAS or "drone"), including several surveying and mapping tasks, in Virginia and several other states, with an option for any state to participate. NSPS has joined with state surveying societies in Virginia and Maryland noting the solicitation does not include a requirement for a licensed professional surveyor, in violation of the law in many other states, as the services sought fall within most licensing law definitions of the practice of land surveying, and, as a professional service. NSPS also pointed out the RFP does not comply with the Virginia qualifications based selection (QBS) law, or similar "mini-Brooks Acts" in numerous other states. The NASPO Cooperative facilitates administration of the cooperative group contracting consortium for the benefit of state departments, institutions, agencies, political subdivisions, and other eligible entities. The Virginia Board for Architects, Professional Engineers, Land Surveyors, Certified Interior Designers, and Landscape Architects (APELSCIDLA) Board and the Maryland Board for Professional Land Surveyors have also expressed opposition to the proposed contract’s failure to recognize state law licensing requirements.

A delegation from NSPS met on Capitol Hill last week with staff of Rep. Rick Crawford (R-AR) to discuss the society’s concerns for provisions in H.R. 5559, the "Scientific Flood Mapping Act of 2018". NSPS members Jim Nadeau and Wendy Lathrop were joined by NSPS Executive Director Cutis Sumner, government affairs consultant John Palatiello and lobbyist John "JB" Byrd. The bill, introduced by Rep. Crawford on April 18, would remove private sector members from the Technical Mapping Advisory Council (TMAC), which advises the Federal Emergency Management Agency (FEMA) on surveying and mapping issues related to the National Flood Insurance Program (NFIP). Lathrop is the NSPS representative on the TMAC. At the June 7 meeting in Washington, DC, NSPS recommended preservation of TMAC and ways to improve the NFIP. A companion Senate bill is being developed, which is likely to include NSPS recommendations.

A new trade and professional association of subsurface utility engineering (SUE) practitioners, the SUE Association, is being formed and an organizing conference will be held on Thursday, July 26 in Washington, DC. The intent of the SUE association is to fill a niche for firms and individuals engaged in providing SUE services, as well as allied stakeholders. The SUE Association is dedicated to supporting, promoting, and increasing client understanding of the ASCE Standard Guideline for the Collection and Depiction of Existing Subsurface Utility Data (38-02) and its organizers have been working diligently to assure the new association complements, and does not compete with or duplicate other trade, professional and technical association activities.

The U.S. Department of Energy's National Energy Technology Laboratory (NETL) has published a dataset identifying 4.8 million structures, such as wells and pipelines, that are part of the oil and gas infrastructure in 194 countries. The data, called the global oil and gas infrastructure inventory (GOGI), standardizes information from 380 datasets and includes data such as the type, age, status, and owner of wells, pipelines, and ports across the world. Researchers can analyze the data to identify potential leaks of methane, a greenhouse gas, to mitigate environmental and economic impacts. The data can also help evaluate the economic costs of current and future energy projects.

The effect of federal infrastructure spending on private-sector productivity depends in part on the response of state and local governments and in part on how long the investment takes to become productive, according to a recent study. Greater emphasis on particular contributions of infrastructure to productivity or different ways of allocating funds could make federal infrastructure spending more productive.
