Brain Portwood, Federal land rights expert and historian of land rights law
Land surveyors often have occasion to address title issues along with boundary issues, making education pertaining to other forms of title (aside from fee ownership of land) relevant to surveyors, in particular those who perform ALTA/NSPS surveys and who wish to provide their clients with a complete and highly informative product. The proper identification and categorization of land rights has become a matter of high importance to our society, and effective documentation of land rights is vital to that task, but verification of federal land rights can be highly problematic, often requiring judicial resolution. This article represents the next in a series on easement issues that arise in the federal context emphasizing the importance of understanding federal land rights, from the perspective of a professional land surveyor. This series is being produced and published for the educational benefit of all those who are employed as professionals in the many branches of the title and land acquisition industry, as well as professional land surveyors.

This article tells of a project initiated to recover evidence of the Osage Treaty Line. This line was run in 1816 and originally intended to serve as the western boundary of Missouri. But shortly after its running, the boundary was moved to the west, and this line dropped off the map. This line happened to be run by the surveyor honored last year with a monument, Joseph C. Brown.

The Small Business Administration (SBA) published its final rule, effective 30 days from publication on July 25, establishing a mentor-protégé program for all small business concerns, which will be separate from, but similar to, SBA's current 8(a) Business Development program. The government-wide program will significantly expand the pool of companies that can qualify as protégés and for which mentors have unique investment and joint venture opportunities to leverage on set-aside procurements.

U.S. Transportation Secretary Anthony Foxx announced recently that the Department established the Build America Bureau (The Bureau), which will drive transportation infrastructure development projects in the United States by streamlining credit and grant opportunities while providing technical assistance and encouraging innovative best practices in project planning, financing, delivery, and monitoring. The Bureau is responsible for driving transportation infrastructure development projects in the United States. The Bureau will streamline credit opportunities and grants and provides access to the credit and grant programs with more speed and transparency, while also providing technical assistance and encouraging innovative best practices in project planning, financing, delivery, and monitoring. To achieve this vision, the Bureau will draw upon the full resources of the Department to best utilize the expertise of all the modes within the Department while promoting a culture of innovation and customer service. A recent Government Accountability Office (GAO) report found that the U.S. Army Corps of Engineers (USACE) and the Federal Emergency Management Agency (FEMA) have made little progress in implementing key national levee-safety-related activities required in the Water Resources Reform and Development Act (WRDA) of 2014. More specifically, the USACE has been working to develop a national levee inventory, but the agencies have taken no action on the remaining key national levee-safety-related activities for which they are responsible under the act. Agency officials identified resource constraints as a primary reason for their lack of progress in implementing such activities, and USACE officials said that not implementing these activities could potentially result in safety risks and federal financial risks for disaster relief, among other impacts. However, the agencies have no plan for implementing the remaining activities required by the act. Without a plan that includes milestones for accomplishing these activities using existing resources or requesting additional resources as needed, the agencies are unlikely to make progress implementing the activities under the act.

The FAA finally has moved on Part 107, the sUAS regulations allowing sub-55 pound UAS to perform commercial work without those pesky Section 333 exemptions.
