The U.S. Department of Labor announced a final rule last week that makes it easier for small businesses that belong to the same trade or professional association to offer retirement plans to their employees. Under the DOL rule, Association Retirement Plans (ARPs) could be offered by associations of employers in the same city, county, state or metropolitan area, or by a particular industry nationwide.
President Trump’s pick for managing federal lands doesn't think the federal government should have any. Last week, Trump's Interior Secretary David Bernhardt signed an order making Wyoming native William Perry Pendley the acting director of the Bureau of Land Management. Pendley, former president of the Mountain States Legal Foundation, was a senior official in Ronald Reagan's administration. The appointment comes as a critical time for the BLM, which manages more than a tenth of the nation's land and oversees the federal government's oil, gas and coal leasing program. Two weeks ago, Interior officials announced the department would reassign 84 percent of the bureau's D.C. staff out West by the end of next year. Only a few dozen employees, including Pendley, would remain in Washington. After more than two and-a-half years in office, Trump has yet to nominate a permanent director for BLM. By placing Pendley in charge of the agency, Bernhardt has installed a longtime crusader for curtailing the federal government's control of public lands.

The Department of the Interior (DOI) is seeking nominations to serve on the National Geospatial Advisory Committee (NGAC). The NGAC is a Federal Advisory Committee first created administratively in 2008 by then-Secretary of the Interior Dirk Kempthorne, and recently authorized in the Geospatial Data Act of 2018 (GDA). The Committee provides advice and recommendations to the Secretary of the Interior through the Federal Geographic Data Committee (FGDC) related to management of Federal geospatial programs, development of the National Spatial Data Infrastructure, and the implementation of the GDA. The Committee reviews and comments on geospatial policy and management issues and provides a forum for views of non-Federal stakeholders in the geospatial community. NSPS member Gary Thompson was re-appointed on the NGAC in April. The GDA requires the appointment of "licensed geospatial data acquisition professionals" to shift away from the current membership’s preponderance of data users. Nominations to participate on this Committee must be received by August 27.

FEMA's Technical Mapping Advisory Council (TMAC) met last week in Arlington, VA. During the two-day meeting, TMAC members conducted a final review and discussion of the TMAC 2018 Annual Report and voted to submit it to FEMA. The TMAC also received public input on the report recommendations and content, including by NSPS Federal Lobbyist John "JB" Byrd. NSPS member Jim Nadeau was appointed earlier this year to the FEMA TMAC for a three-year term and is pictured (on the right side of the photo) with TMAC Chairman Jeff Sparrow and former NSPS representative to TMAC Wendy Lathrop.

On July 31, 2019, the TMAC met for the first time since their last official meeting on September 25 and 26, in Reston, VA. The 11-month hiatus between in-person meetings was primarily due to there being too few members to have a voting quorum as a result of the Trump Administration’s delay in vetting new members and reappointing existing members. Appointments were delivered via email to members in March 2019, and phone meetings followed to bring all members back to current.

As the National Flood Insurance Program (NFIP) continues to move into the future, a big change tentatively set to occur next year is Risk Rating 2.0, an initiative which will allow FEMA to focus on "building a culture of preparedness" by closing the insurance gap. Risk Rating 2.0 is intended to include benefits such as: creating an individualized picture of a property's risk; providing rates that are easier to understand by agents and policyholders; reflecting more types of flood risk in rates; using the latest actuarial practices to set risk based fees; and reducing the complexity for agents to generate a quote. As an example, one of the characteristics of Risk Rating 2.0 pertains to delivering fair rates for owners of lower-value homes as it relates to the cost to rebuild (FEMA, 2019).
