Digital Coast Act Passes U.S. Senate
NSPS
The U.S. Senate last night passed the Digital Coast Act, S. 1069. The accompanying Senate committee report is report No. 116-234. The House passed the Digital Coast bill as part of a larger bundled bill, H.R. 729, the "Coastal and Great Lakes Communities Enhancement Act", on December 10, 2019. The House of Representatives must now pass the freestanding Senate-passed bill. NSPS government affairs consultants, John M. Palatiello & Associates, Inc. manage a broadly based Digital Coast Partnership Advocacy Coalition, of which NSPS is a member, that has led efforts in support of the legislation.

Senator Cramer References NSPS on FLAIR Act
NSPS
Senator Kevin Cramer (R-ND) applauded the Senate Energy and Natural Resources (ENR) Committee for fulfilling his request to hold a hearing last week on his Federal Land Asset Inventory Reform (FLAIR) Act, S. 1295, a bipartisan bill to create a single database for lands owned by the federal government. “There should be no discrepancy over how much land the federal government does or does not own,” Senator Cramer noted in a news release. “By adopting the FLAIR Act, we can improve federal land management, resource conservation, and recreational access, all while reducing land ownership conflict and saving taxpayer dollars in the maintenance of one efficient database.” Senator Cramer introduced the FLAIR Act in May 2019 with Senator Martin Heinrich (D-NM) and subsequently requested the bill be considered before the committee. NSPS was quoted in the news release, “This federal effort helps state and local agencies verify their ongoing efforts to identify what each level of government owns,” said NSPS Government Affairs Consultant John Palatiello. “This will also enable government at all levels to find missing property.”

National Academies Launch Committee for Sustainable Development
NSPS
The National Academies of Science has introduced a national committee to serve as the voice of the U.S. scientific community during the UN Decade of Ocean Science for Sustainable Development, which will run from 2021 to 2030. The U.S. National Committee for the Decade is comprised of the experts who regularly advise the National Academies’ Ocean Studies Board, joined by experts who advise the National Academies’ Science and Technology for Sustainability Roundtable, Marine Board, and Gulf Research Program. Committee functions include establishing communication channels among participating organizations, organizing webinars, and convening meetings to promote and highlight Decade activities. U.S. organizations participating in the Decade can connect with the U.S. National Committee for the Decade through a new website, “Ocean Decade U.S.” Organizations are encouraged to complete an application to join the Ocean Decade U.S. Nexus. Nexus participants will be able to submit news and events from publishing to the website. The U.S. National Committee is also seeking early career professionals to serve as liaisons to the committee and provide a voice for the next generation of ocean scientists. UAS Integration into the National Airspace System Updated

In the Federal Aviation Administration (FAA) reauthorization act of 2018, Congress provided for Government Accountability Office (GAO) to study and report on federalism (federal and state jurisdiction) and personal privacy issues that have been raised in connection with the Federal Aviation Administration's ongoing development of a regulatory framework to safely integrate unmanned aircraft systems (UAS)—commonly known as drones—into the national airspace system. In the just released report, GAO analyzed the current state of the law, including the uncertainties, differing legal positions, concerns raised about the current state of the law, and a review of relevant legal authorities as well as the legal views of legal commentators and 66 government and non-government stakeholders interviewed. The law on a number of key matters is in a state of flux. The federal government is still developing key aspects of its UAS requirements and there have been few court decisions to date addressing whether these requirements are consistent with statutory authorities. Unresolved legal issues discussed in our report include the scope of FAA’s authority over low-altitude UAS operations, and the potential liability of UAS operators and governments to landowners under aerial trespass and takings principles.

Senate Acts, Avoids Government Shutdown
NSPS
The Senate on Wednesday evening passed H.R. 8337, a bill making continuing appropriations for fiscal year 2021, and for other purposes. This is identical to the bill passed last week in the House and now goes to President Trump for his signature before midnight. The bill extends funding for the fiscal year that begins tomorrow through December 11 and avoids a government shutdown or any lapse in contractor tasking or services. It also extends the National Flood Insurance Program (NFIP) in FEMA and the current Highway bill (FAST Act ) in the Federal Highway Administration through September 30, 2021, as requested by a broad coalition of groups, including NSPS.
