This article is Part 2 in a quarterly series on the wide variety of issues associated with boundary and easement disputes which arise in the federal context, emphasizing the importance of understanding the historical origin of federal land rights, from the perspective of a professional land surveyor. On December 7th we will bow our heads in remembrance of the valiant Americans who lost their lives on that date in 1941 defending Pearl Harbor, but on the following day, let us also pause to reflect upon the importance of our own work. December 8, 2019, marks the 100th anniversary of the formal inauguration of the most intensive land rights litigation in our nation’s history. This 19th edition, documenting the historical events which made the Red River of the South a major focal point of controversy a century ago, has been split into 4 parts, due to its extensive length. The Congressional Budget Office (CBO) recently provided a cost estimate for H.R. 2189, the Digital Coast Act. The bill elevated the Digital Coast project in NOAA as a fully authorized program. Under the current project, NOAA makes available on a public website geospatial data, decision-support tools, and best practices regarding the management of coastal areas. In 2019, NOAA used $2 million of appropriated funds to carry out the program. The bill also would direct NOAA to focus additional data collection efforts on underserved coastal areas, such as in the Arctic. Using information from NOAA, CBO expects that the resources necessary to implement the Digital Coast Program under H.R. 2189 would be higher than the resources necessary under current law because of the costs associated with transporting equipment to the Arctic and other underserved areas for additional data collection. Accounting for that, CBO estimates that implementing H.R. 2189 would cost $15 million over the 2020-2024 period, assuming appropriation of the necessary amounts. NSPS is a leading proponent of the Digital Coast Act.

A recent Government Accountability Office (GAO) report found that outside of the auspices of Title 13-protected Census data, states and federal agencies have worked toward making a national address database publicly available. For example, the National Address Database, managed by the U.S. Department of Transportation in cooperation with the Census Bureau, is an open source database which enables governments to view and submit their address information, including geospatial coordinates, for use across governmental agencies. In 2015, GAO reported on the National Address Database and Title 13, suggesting that Congress consider assessing statutory limitations in Title 13 on address data to foster progress toward such a national address database. However, there has been no legislative action since that report.

The USDA is seeking public comments on hemp production per the Agriculture Improvement Act of 2018, the Farm Bill. This rule outlines provisions for the Department of Agriculture (USDA) to approve plans submitted by States and Indian Tribes for the domestic production of hemp. Plans will need to contain a process by which relevant information regarding the land used for hemp production in their jurisdiction is collected and maintained. All information on hemp production sites must be collected for each producer covered by the State or Tribal plan. The information required to be collected includes a legal description of the land and geospatial location, which the USDA Farm Service Agency (FSA) can help provide, for each field, greenhouse, or other site where hemp is produced. Geospatial location is required because many rural locations do not have specific addresses and these coordinates will assist with the proper identification of hemp production locations. Per statute, States and Tribes will need to retain these records for three years.

The U.S. Geological Survey National Geospatial Program has released a new version of the USGS LiDAR Base Specification that defines deliverables for nationally consistent LiDAR data acquisitions.
This update of the LiDAR Base Specification better aligns the specification with the LiDAR data workflow in the USGS NGP, streamlines the data publishing workflow, clarifies language, and addresses Federal requirements to use non-proprietary data formats.

A record-breaking number of exhibitors and attendees gathered for Commercial UAV Expo Americas 2019, held Oct. 28-30 at the Westgate Hotel in Las Vegas. The fifth annual event had 202 exhibitors and more than 3,100 professionals in the commercial drone industry, cementing its place as the largest and most important commercial UAS-focused event in North America. "The year-over-year growth was tremendous," said Lisa Murray, Group Director at Diversified Communications, which produces the event.

The Department of Transportation selected 11 firms to demonstrate technologies that could be used to back up the services provided by GPS should GPS signals be jammed, spoofed or unavailable.
DOT did not specify how much each firm was awarded. The total amount allocated to the 11 companies was $2,507,500, making the average level of the contracts to each firm $230,000. The government had said in late September that it might award up to 20 contracts for demonstrations.

The National Geospatial-Intelligence Agency is all about data. And the agency, which is set to break ground on a new nearly $2 billion facility in St. Louis later this month, is hoping to get more of it unclassified for better analysis and information for the warfighter.

GPS World
China sent a new satellite of the BeiDou Navigation Satellite System into space from the Xichang Satellite Launch Center in Sichuan Province at 17:43:04.482 UTC on Nov. 5.
Launched on a Long March-3B carrier rocket, it is the 49th satellite of the BDS satellite family and the 24th satellite of the BDS-3 system.
It also marked that a total of three BDS-3 satellites have been sent into the inclined geosynchronous Earth orbit.
