Whether your individual beliefs relate to Christmas, Hanuka/Chanukah, or some other affiliation, at this time of year, especially, the NSPS leadership team and staff wishes to thank each of you for your support of the organization and its endeavors. Your continued support is what makes it possible for NSPS to do the things it needs to do in order to represent Surveyors (and surveying) whether that is through outreach programs, advocacy, or interaction with other organizations. Moreover, it is your dedication to the profession in your day-to-day activities and involvement with clients, citizens, governmental entities, and other professionals that results in the high esteem our profession enjoys (even though we sometimes might not realize it).

A new tool has been added in the constant fight against unlicensed practice; the Surveyor of Record affidavit. This important tool became effective on July 1, 2017 by being codified in the Engineering and Surveying Practice Act.
In part, the Act states the following: Professional surveyors may engage in the practice of surveying and perform surveying work pursuant to the Engineering and Surveying Practice Act [61-23-1 NMSA 1978] as individuals or through a business entity.1
The Act defines business entity as "... a corporation, professional corporation, limited liability corporation, professional limited liability corporation, general partnership, limited partnership, limited liability partnership, professional limited liability partnership, a joint stock association or any other form of business, whether or not for profit."2 In short, this covers anyone in the surveying business in New Mexico including sole proprietors. I have been asked to provide a quote for an ALTA survey of an oil refinery. The operating plant covers about 150 acres including its storage tanks. The main question I have is "Do all of the structures within the property need to be located, including the piping and tanks?"
Can anything be shown based on using aerial photography in the background? Any insight you can give me is greatly appreciated.
Response:
The best and most logical way to deal with this would be to suggest to the client that it be covered under Table A Item 15, which reads:
Rectified orthophotography, photogrammetric mapping, remote sensing, airborne/mobile laser scanning and other similar products, tools or technologies as the basis for the showing the location of certain features (excluding boundaries) where ground measurements are not otherwise necessary to locate those features to an appropriate and acceptable accuracy relative to a nearby boundary. The surveyor shall (a) discuss the ramifications of such methodologies (e.g., the potential precision and completeness of the data gathered thereby) with the insurer, lender, and client prior to the performance of the survey, and (b) place a note on the face of the survey explaining the source, date, precision, and other relevant qualifications of any such data.

Congress and the General Services Administration have announced the release of an updated Federal Real Property Profile. This is the result of the Federal Assets Sale and Transfer Act (FASTA) of 2016, (Public Law 114-287). The federal government owns or leases 5,066 bathrooms, occupying nearly 1.7 million square feet of the government’s 1.9 billion feet of total office space. Uncle Sam also controls 16,570 parking lots and garages, more than 1,500 prisons, nearly 17,000 warehouses, 766 hospitals and 2,427 schools. A Government Accountability Office (GAO) report has found that The Department of Defense's (DOD) acquisition of the next generation Global Positioning System (GPS) satellites, known as GPS III, faces a number of acquisition challenges, but these challenges do not threaten DOD's ability to continue operating the current GPS system, which DOD refers to as the constellation, in the near term. Projections for how long the current constellation will be fully capable have increased by nearly 2 years to June 2021, affording some buffer to offset any additional satellite delays. While the first GPS III satellite has a known parts problem, six follow-on satellites — which do not — are currently scheduled to be launched by June 2021.

NSPS lobbyist John "JB" Byrd recently met with Rick Saccone (R), a candidate for an open seat in the U.S. House of Representatives from Pennsylvania vacated by the resignation of Rep. Tim Murphy (R). The special election in the 18th Congressional District is set for March 2018. After retiring from the Air Force, Saccone served in a diplomatic role in North Korea — the only American living in North Korea at the time. In 2010, he decided to run for the Pennsylvania State House, where he now serves in his fourth term.

Senate lawmakers have introduced a bi-partisan bill giving the Department of Transportation responsibility for launching a GPS timing backup and a two-year deadline to get it up and running.
Sponsored by Sens. Ted Cruz, R-Texas, and Ed Markey, D-Massachusetts, the National Timing Resilience and Security Act of 2017 would put a stop to interagency maneuvering over which organization is stuck with developing, managing and, most importantly, paying for the new system.
